The following terms, wherever used herein or referred to in this chapter,
shall have the respective meanings assigned to them, unless a different meaning
clearly appears from the context:
The fee charged by and payable to the City of Long Branch to obtain
a license.
A license issued by the Fire Official for the purposes stated.
Anyone who employs the services of a landscaper to perform the services
of maintaining, cutting, cleaning or raking property within the City of Long
Branch.
Any person or persons over the age of 18 doing business with three
or more residential or commercial customers for the purpose of maintaining,
cutting, cleaning or raking hedges, trees, limbs, leaves, cuttings and other
items or activities commonly performed by persons undertaking landscaping
activities.
Any vehicle required to be registered with the New Jersey Division
of Motor Vehicles for use on local roads and highways and used by a landscaper
in the performance of his work in the City of Long Branch.
All landscapers performing landscaping services within the City of Long
Branch shall be required to obtain a license in order to offer their services
in the city. One license shall be required for all vehicles the landscaper
owns or operates within the City of Long Branch. A license decal must be clearly
displayed on each vehicle that the landscaper owns for business use. Multiple
decals may be obtained from the Fire Official at the time of license application.
Said license shall be obtained prior to January 1 of each calendar year. Proof
of licensure will be demonstrated by the issuance of and the display of a
decal, which will be issued to each licensee and displayed on the lower right-hand
corner of the windshield of each vehicle the landscaper owns or operates for
business use in the City of Long Branch.
A.Â
Applications for licensing as required by this chapter
shall be made to the Fire Official on a form furnished by him.
B.Â
The application shall set forth the following information:
(1)Â
The applicant's name, business name, business address,
home address of owner and business and home telephone numbers.
(2)Â
Whether the applicant is an individual, a partnership,
corporation or any other entity.
(3)Â
The number of years the applicant has been in business
at his present address or at any prior location, including the addresses of
such prior locations, if any.
(4)Â
The make, year and license plate number of each vehicle
used in the business.
(5)Â
Whether the applicant or any partners or officers of
the corporation have ever been arrested or convicted of a crime and, if so,
the name of the person arrested or convicted, the date of arrest, the crime
or charge involved and the disposition thereof. The term "officer" shall mean
the President, Vice President, Secretary and Treasurer of a corporate applicant.
Every landscaper operating within the City of Long Branch shall be required
to comply with the following:
A.Â
The name of the landscaping company shall be clearly
displayed on both sides of any vehicles used in said operation, shall be no
less than three inches in height and shall include the name, address and telephone
number of the landscaper.
B.Â
All landscapers may dispose of all cuttings, clippings
and their waste materials at a location in the manner directed by the Director
of the Department of Public Works of the City of Long Branch. The landscaper
shall only dispose of said materials from properties located within the City
of Long Branch.
A.Â
Upon filing such application, the applicant shall pay
to the Fire Official an annual fee of $50 for up to five vehicles and $5 for
each vehicle over five. Any fraction of a year will be considered a full year
for the purposes of this chapter.
B.Â
The term of such license shall expire on December 31
of the calendar year in which such license is issued.
C.Â
Such license shall be automatically renewed by the Fire
Official upon payment by the applicant of an annual renewal fee of $50. Such
renewal shall be for the calendar year in which such renewal occurs.
A.Â
If any person licensed in accordance with the provisions
of this chapter shall be convicted of violating any statute, ordinance or
regulation in the execution of any work for which a license is required by
the applicable ordinances of the City of Long Branch relevant to landscaping,
the Fire Official shall revoke the license of such person immediately. The
Fire Official shall not restore such license during such time as the violation
for which such conviction was obtained, exists or remains.
B.Â
Any person whose license has been revoked under the provisions
of this chapter may be relicensed by the Fire Official when the grounds upon
which such license was revoked are removed or corrected and upon payment of
the fee prescribed herein.
A.Â
Any person who violates any provision of this chapter,
other than disposal requirements, shall, upon conviction, be punished by a
fine not exceeding $500 or by imprisonment for a term not exceeding 90 days,
or both. A separate offense shall be deemed committed on each day during or
on which a violation occurs or continues.
B.Â
Any person who violates the disposal requirements of
this chapter shall, upon conviction thereof, be punished by a fine not exceeding
$1,000 or by imprisonment for a term not exceeding 90 days, or both. A separate
offense shall be deemed committed with each violation of this provision.
This chapter may be enforced by any officer who is in the employ of
any department or branch of the government of the City of Long Branch, County
of Monmouth or State of New Jersey relating to health, police/public safety
activities, fire, property maintenance, code enforcement, building regulations
or other activities concerning buildings and lands in the municipality.
