The purpose of this article is to establish standards and controls of and for various types of fire, intrusion or other emergency signals from fire and police alarm devices which require fire or police response or investigation. The Board of Trustees of the Incorporated Village of East Hills finds that the public interest, safety, health and welfare is best protected by an article which provides for the installation and maintenance of an automatic shutoff device with respect to fire and intrusion alarms installed within the Village. While recognizing the efficacy of such devices for the protection of the individual home and homeowner or business located within the Village, the uncontrolled sounding of such alarms has serious implications with respect to the health, safety and welfare of Village residents.

It shall be unlawful for any owner, lessee or occupant of any real property in the Incorporated Village of East Hills to:
A. 
Install, maintain or use upon said real property an audible burglar alarm or audible fire alarm that is not provided with a device that will automatically terminate such alarm after 20 minutes of continuous sound audible beyond the boundaries of such property.
B. 
Suffer or permit such burglar alarm to emit sound audible beyond the boundaries of such real property for a continuous period of more than 20 minutes, whether or not said alarm has been equipped with the automatic shutoff device required by Subsection A.
C. 
Allow excessive "false alarms," defined as any emergency message or signal that requires a response by the Police or Fire Department, that is not canceled by the owner, lessee or occupant prior to police or fire response, which message or signal is not the result of a robbery, burglary or other crime or emergency.

A. 
For every alarm violating the provisions of § 59-2 hereof, after the first such alarm, the following schedule of fines shall be applicable:
(1) 
For the second and third such alarms of each calendar year: $25 for each such offense.
(2) 
For the fourth and fifth such alarms of each calendar year: $50 for each such offense.
(3) 
For each such alarm over five in each calendar year: $100 for each such offense.
B. 
This section shall be enforced by any person designated by the Mayor and Board of Trustees to issue appearance tickets.
In addition to penalties set forth herein, the Board of Trustees of the Village may authorize the institution of a suit enjoining the owner, lessee or occupant of any real property in the Incorporated Village of East Hills from maintaining an alarm system in contravention to the provisions which require the installation of automatic shutoff devices hereinabove set forth.
