GENERAL REFERENCES

For the purpose of this chapter, the terms used herein are defined as follows:
BOAT
A vessel capable of carrying one or more people and intended for use on or in water.
BUILDING
Any structure having a roof supported by columns or by walls and intended for the shelter, housing or enclosure of persons, animals or chattel.
CAMPER
A motorized, self-propelled vehicle containing sleeping and other facilities for habitation.
COMMERCIAL REPAIR
Repair for compensation in cash, kind or other property or service.
COMMERCIAL STORAGE
Storage for compensation in cash, kind or other property or service.
COMMERCIAL VEHICLE
Any vehicle used in connection with any business or trade, with the exception of the automobile of a salesman, professional person or the like.
CONSTRUCTION VEHICLE
A commercial vehicle customarily used in the construction trades, including but not limited to vehicles used for excavation and the moving of earth and vehicles used for the hauling of construction materials.
DUMPSTER
See "trailer, utility."
DWELLING
A building designed or used as the living quarters for one or more families, other than a tourist home, tourist court, motel, hotel or rooming house.
FAMILY
One or more persons, whether or not related to each other by blood, marriage or adoption, all living together as a single, stable bona fide housekeeping unit, so long as such persons together occupy and own, lease or rent the whole of a separate building or dwelling unit in a family-like arrangement as the functional and factual equivalent of a natural "family" and use all rooms and housekeeping facilities in common.

LOT, CORNER
A parcel of land at the junction of and fronting on two or more intersecting streets. Where a parcel of land fronts on more than one street, all portions of the yard fronting on any such street shall be considered to be the front yard, and all other yards shall be considered to be side yards.
MOBILE HOME
A structure mounted on axles and wheels, containing living facilities, and which may be towed by automobile or truck from place to place. Such structure will be considered a "mobile home" for purposes of this chapter whether or not the wheels and axles are still in place.
MOTORCYCLE
A motorized unenclosed vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground.

PARK OR PARKING
The standing of a vehicle, whether occupied or not, on public or private property.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
RECREATIONAL VEHICLE
See "camper."
REPAIR
Restore to sound or good condition; alter or improve the appearance or internal operation of a vehicle.
SEMITRAILER
A detachable trailer for hauling freight, having its forward end supported by the rear of its truck tractor, when attached.
STORAGE
The parking of a vehicle for a period in excess of 24 hours.
TEMPORARY
For a duration of less than 24 consecutive hours.

TRACTOR
A short truck with a body containing only a cab for the driver, used to haul detachable trailers.
TRACTOR-TRAILER
A combination trucking unit consisting of a tractor and trailer or semitrailer.
TRAILER
A vehicle drawn or towed by another vehicle, except motorcycle sidecars.
TRAILER, BOAT
A trailer intended for the purpose of moving boats from place to place.
TRAILER, CAMPER
A trailer containing sleeping and other facilities, the outside walls of which are partially collapsible into the body of the trailer to facilitate towing.
TRAILER, HOUSE
Any portable or mobile vehicle used or designed to be used for living purposes and with its wheels, rollers or skids in place.
TRAILER, UTILITY
A trailer generally used for the hauling of miscellaneous household and yard materials.
VEHICLE
All of the foregoing vessels, vehicles, structures and trailers, and also including every device in, upon or by which any person or property is or may be transported or drawn upon a highway.
VEHICLE, UNLICENSED
Any vehicle without current and valid registration or valid license plates affixed to the vehicle.

VILLAGE
The Incorporated Village of East Hills.
YARD, FRONT
An open unoccupied space on the same lot with the building between the front line of the building and the front line of the lot extending the full width of the lot.
YARD, REAR
An open unoccupied space on the same lot with the building between the rear line of the building and the rear line of the lot extending the full width of the lot.
A. 
No camper, camper trailer, mobile home or house trailer shall be stored outside at any place in the Village on public or private property without first obtaining a permit authorized by the Village Board of Appeals after a public hearing.
B. 
Subject to obtaining a permit pursuant to the Village Board of Appeals' authorization, a camper, camper trailer, mobile home or house trailer having an overall length of 24 feet or less may be parked or stored on private property subject to the following regulations:
(1) 
Such vehicle must belong to an owner or occupant of the premises upon which it is being parked or stored.
(2) 
Only one such vehicle per family may be parked or stored on any lot containing the dwelling unit of such family.
(3) 
The parking or storage of such vehicle shall be in full compliance with the off-street parking requirements of this Code and shall not preempt the use of space needed for the off-street parking of other vehicles.
(4) 
The parking or storage of such vehicle shall be in full compliance with the vehicle and traffic regulations of this Code.[1]

(5) 
Such vehicle shall not be used for any residential purpose or temporary habitation within the Village.
(6) 
The foregoing notwithstanding, there shall be no restriction on such vehicles parked or stored within an enclosed garage which is part of a dwelling unit.
C. 
No camper, camper trailer, mobile home or house trailer over 24 feet in length shall be stored outside at any place in the Village on public or private property.

A. 
No boat or boat trailer shall be stored outside at any place in the Village on public or private property.
B. 
Any violation of this chapter, in the determination of the Building Inspector, in existence on the date of enactment of this section shall be cured within 90 days of such enactment. Any such failure to cure shall subject the property owner to all penalties provided by this chapter.
C. 
Any permit for storage of a boat or boat trailer granted by the Board of Appeals prior to enactment of this section shall not be renewable.
A. 
The application to the Village Board of Appeals for a permit for the parking or outside storage of any vehicle, other than a boat or boat trailer, hereunder shall be accompanied by:

(1) 
Receipts of certified mailing of written notice to all resident homeowners living within 200 feet of the outer extremities of the applicant's property.
(2) 
A nonrefundable application fee for the public hearing expenses incurred, which fee shall be set forth from time to time by resolution of the Board of Trustees.[1]

B. 
If the Village Board of Appeals grants the permit, a separate permit fee shall be imposed, and the duration of such permit shall be set by the Board of Appeals in conjunction with and as part of the resolution authorizing the permit.
C. 
Such permit fee as prescribed by the Board of Trustees shall be paid upon issuance of the permit.
D. 
Such permit may be renewed annually with the annual fee to be determined by the Board of Trustees.[2]

A. 
No utility trailer, commonly called a "dumpster," shall be parked or stored on any public street at any time. Such utility trailer or dumpster may be parked or stored outside on private property only during such time that construction activity is in progress at the premises on which the utility trailer or dumpster is parked or stored.
B. 
No commercial vehicle of any type, nor any tractor, tractor-trailer, semitrailer or construction vehicle of any type, shall be stored outside on any private or public property in the Village, except those used by the homeowner for personal transportation.
C. 
No commercial vehicle of any type, nor any tractor, tractor-trailer, semitrailer or construction vehicle of any type, shall be parked outside on any public or private property in the Village unless temporarily in connection with a bona fide commercial service, sales or delivery visit to such property.
D. 
The restrictions of Subsections B and C of this section shall not apply to:
(1) 
Village-owned vehicles.
(2) 
The Light Industrial A District.

(3) 
Commercial vehicles and/or equipment used in connection with the harboring of horses as authorized pursuant to Chapter 271, Zoning, of this Code.
No vehicle, as defined in this chapter, shall be parked or stored outside in a residence district on any privately owned vacant property held in single and separate ownership.

The outside storage of unregistered, inoperative and/or discarded vehicles on privately owned property within the Village of East Hills is a source of annoyance to residents and to owners and occupants of adjacent land. The outdoor storage of such vehicles is unsightly and constitutes an attractive nuisance to children and a peril to their safety. The purpose of this section is the preservation of peace and good order, the protection of public health and property and the prevention of fires and explosion.
A. 
No unregistered, inoperative or discarded vehicles, except as may otherwise be permitted in this chapter, shall be parked or stored outside on any public or private property in the Village.
B. 
The restrictions of Subsection A of this section shall not apply to:
(1) 
Village-owned vehicles.
(2) 
The Light Industrial A District.
(3) 
Duly authorized new and used car agencies.
A. 
In any residential district, any repairs made to any vehicle should be completed in one twenty-four-hour period unless the vehicle is in an enclosed building.
B. 
Commercial repair of vehicles in a residential district is prohibited.
A. 
Any duly authorized police officer, designated official or employee of the Village of East Hills may, by service of a summons or appearance ticket, require the owner, occupant or person having charge of the property on which a violation of this chapter exists to appear before the Village Justice of the Incorporated Village of East Hills.
B. 
In addition to any other penalty which may be imposed pursuant to law, the Village Justice shall be empowered to direct that any vehicle or vehicles be removed and the violation corrected within 15 days from the return date of the summons or appearance ticket.
C. 
In the event that the violation is not removed or corrected within such time as shall be provided by the Village Justice Court, the Village Board of Trustees may, pursuant to law, order its authorized agent to perform such work as shall be necessary to remove or correct the violation and charge the costs thereof against the land, to be a lien against the property and to be collected as taxes.
D. 
Any vehicle removed from the property may be declared as abandoned property by the Board of Trustees and disposed of pursuant to law. This remedy shall be in addition to any other penalty which may be imposed or provided by law.

A violation of this chapter shall, upon conviction, be punishable as provided in Chapter 1, General Provisions, Article III.
