[HISTORY: Adopted by the Town Board of the Town of Orchard Park as Secs. D-9 through D-16 of the 1970 Code. Amendments noted where applicable.]
There is hereby created a Planning Board for the town, which shall be composed of seven members.
Pursuant to § 276 of the Town Law, the Planning Board is authorized and empowered to approve plats showing lots, blocks or sites with or without streets or highways and to conditionally approve preliminary plats, within that part of the town outside of the limits of the Village of Orchard Park.
The Planning Board is authorized and empowered to pass and approve the development of plats already filed in the office of the County Clerk if such plats are entirely or partially undeveloped.
The Planning Board is hereby authorized and empowered simultaneously with the approval of any plat either to confirm the zoning regulations of the land so platted, as shown on the official Zoning Maps of the town, or to make any reasonable change therein as provided by § 281 of the Town Law.

Pursuant to § 277 of the Town Law, the Planning Board is authorized and empowered before its approval of a plat showing the lots, blocks or sites or in connection with the approval of a plat, already filed in the office of the County Clerk, if such plat is entirely or partially undeveloped, to require an open land area equal to at least 9% of the total area represented by said plat to be conveyed to the town for playground or other recreational purposes and that the minimum size of said open area be at least four acres. Floodplains, protected wetlands or existing drainage areas shall not be used to meet the open land area minimum requirements.
The Planning Board is hereby authorized and empowered to approve or disapprove changes in the lines of existing streets, highways or public areas shown on subdivisions, plats or maps filed in the County Clerk's office.

The Planning Board is hereby authorized to approve or disapprove the laying out, closing off or abandonment of streets, highways or public areas under the provisions of the Town Highway Law.
The Planning Board is hereby authorized and empowered to approve, modify and approve or disapprove plats showing new streets and highways.
The Planning Board is hereby authorized to report with its recommendations for approval or disapproval any proposed amendment, supplement, change, modification or repeal of the whole or any part of the Town Zoning Ordinance.
