[HISTORY: Adopted by the Town Board of the Town of Philipstown 12-1-88 as L.L. No. 6-1988. Section 4-2 amended at time of adoption of Code; see Ch. 1, General Provisions, Art. I. Other amendments noted where applicable.]
The purpose of this chapter is to authorize certain public servants of the Town of Philipstown to issue and serve appearance tickets in connection with violations of state statutes, local laws, ordinances, rules or regulations of the town which the public servants are authorized or required to enforce.

The following public servants of the Town of Philipstown are hereby authorized to enforce and to issue and serve appearance tickets with respect to violations of the state statutes, local laws, ordinances, rules or regulations set forth below:
A. 
The Building Inspector and/or any Deputy or Assistant Building Inspector and/or any Zoning Administrative Officer and/or any Deputy or Assistant Zoning Administrative Officer and/or any Enforcement Officer or Deputy or Assistant Enforcement Officer:
(1) 
The New York State Uniform Fire Prevention and Building Code (see Chapter 62).
(2) 
The Town of Philipstown Land Development Regulations (see Chapter 112).
(3) 
The Town of Philipstown Zoning Law (see Chapter 175).
(4) 
An Ordinance Regulating and Licensing Junkyards and Dealers in Used Property or Waste Materials in the Town of Philipstown (see Chapter 107).
(5) 
The Town of Philipstown Local Law Regulating the Collection and Disposal of Garbage, Refuse, Rubbish and Waste (see Chapter 99, Article III).
(6) 
An Ordinance Regulating Disposal of Garbage, Rubbish, Refuse, Animal Matter, Paper and Litter (see Chapter 99, Article I).
(7) 
The Freshwater Wetlands and Watercourses Law of the Town of Philipstown (see Chapter 93).

(8) 
The Town of Philipstown Mandatory Recycling Law (see Chapter 99, Article IV).

B. 
The Highway Superintendent and/or any Deputy or Assistant Highway Superintendent:
(1) 
An Ordinance Regulating Disposal of Garbage, Rubbish, Refuse, Animal Matter, Paper and Litter (see Chapter 99, Article I).
(2) 
The Town of Philipstown Mandatory Recycling Law (see Chapter 99, Article IV).

C. 
The Fire Marshal and/or any Deputy or Assistant Fire Marshal:
(1) 
The New York State Uniform Fire Prevention and Building Code (see Chapter 62).
D. 
The Wetlands Inspector and/or any Deputy or Assistant Wetlands Inspector:

The Freshwater Wetlands and Watercourses Law of the Town of Philipstown (see Chapter 93).
The authority granted herein is in addition to the authority granted to any public servant of the Town of Philipstown under any other statute, local law, ordinance, rule or regulation and is not intended to curtail, replace or supersede any authority given in any other such legislation or grant of authority.[1]

An appearance ticket other than for a parking violation shall be served personally.
