This personnel policy will apply to all Town of Philipstown salaried employees, except those covered by contracts with their representative unions. This policy may be amended from time to time by the Town Board.

The normal operation of the Town Hall and hours during which it shall be open are as follows: 8:30 a.m. to 4:00 p.m., with 1/2 hour for lunch, five days per week (Monday through Friday).
The normal workweek is 35 hours; adjustments should be made accordingly in order to maintain a thirty-five-hour week. Some departments, by nature of their operation, will not conform to the above hours. The Clerk to the Highway Superintendent shall adhere to the normal work schedule of the Highway Department.
A. 
All overtime hours are to be documented on time records by the department head. Those considered as department heads are as follows:
(1) 
Town Clerk.
(2) 
Chairman, Assessors' Department.
(3) 
Director, Recreation Department.
(4) 
Town Highway Superintendent.
(5) 
Building Inspector.
(6) 
Town Supervisor.
(7) 
Town Justices.
B. 
Each department head shall keep current time records on all employees in his or her particular department, including his or her own, which are to be certified and filed with the Town Clerk's office biweekly.
C. 
There will be no compensation (either monetary or compensatory time off) for overtime unless specifically approved in advance by the department head. Employees who work overtime hours may take compensatory time off equal to the number of overtime hours worked (in lieu of monetary compensation) at a time mutually agreeable to the department head and the employee. Compensatory time must be taken within six months from when it is earned. All overtime must be documented on time records. The five hours between 35 and 40 hours per week shall be paid at straight time. Time worked in excess of this (over a forty-hour workweek) shall be paid at time-and-one-half.

New employees shall serve a probationary period of six months.

A. 
Vacation with pay shall be granted to full-time employees in payroll status on the following accrual basis:
(1) 
One to five years: 2.5 hours per pay period, plus five hours last pay period, equals 70 hours or 10 days.
(2) 
Five to 10 years: four hours per pay period, plus one hour last pay period, equals 105 hours or 15 days.
(3) 
Ten to 20 years: 5.25 hours per pay period, plus 3.5 hours last pay period, equals 140 hours or 20 days.
(4) 
Vacation time may be accrued to a maximum of 30 days.
B. 
Part-time workers will accrue vacation credits per the following schedule:
(1) 
First year: 1.25 hours per pay period after six months, plus 1.25 hours last pay period, equals 2.5 days.
(2) 
Two to five years: 1.25 hours per pay period, plus 2.5 hours last pay period, equals five days.
(3) 
After five years of service: 2.5 hours per pay period, plus five hours last pay period, equals 70 hours or 10 days.
C. 
Vacation scheduling shall be subject to the approval of the department head.

A. 
Full-time employees shall accrue sick leave at the rate of 3.5 hours per two-week period, based on a thirty-five-hour week. The Clerk to the Highway Superintendent shall accrue sick leave at the rate of four hours per two-week pay period, based on a forty-hour week.
B. 
Part-time employees shall earn sick leave at the rate of 1.75 hours per two-week period, or 3.5 hours per month.

Full-time employees may, at the discretion of the department head, be allowed up to four personal days during each year of service. Personal time may not be taken during the probationary period and may not be carried from year to year.
Termination of employment is at the discretion of the Town Board or the department head when so provided by law.
Each department head shall keep a file on all employees containing a record, with dates and notations, of tardiness, verbal or written disciplinary action or termination.
Any employee with a grievance shall submit the same to the Town Board in writing. The Town Supervisor may act as liaison for the Town Board in order to expedite acute situations. Employees may request to appear in person if they so desire. The Town Board will set the date for such appearance, which will be on at least five days' notice to the employee, unless an earlier date is mutually agreed upon.
Employees serving on jury duty will receive the regular rate of pay minus the rate paid for jury service. An employee under subpoena to appear in court on town business expressly in behalf of the town will receive his or her regular rate of pay.
Upon request, employees may review the contents of their own personnel files.
No alcoholic beverages or controlled substances (as that term is defined in § 3306 of the Public Health Law) shall be consumed, ingested or assimilated on town property or in town buildings or on the job.
