It is the intent of this article to establish a mandatory recycling
program within the Town of Philipstown and to empower the Town Board to adopt
regulations therefor, thereby promoting and protecting the health, safety
and welfare of the residents of the town, conserving energy and natural resources
and protecting the environment.
As used in this article, the following terms shall have the meanings
indicated:
Includes all individuals, partnerships, corporations, municipalities,
owners, tenants, lessees, occupants, associations and organizations residing
or owning, operating, managing, leasing or occupying any premises, land, residence
or business within the Town of Philipstown.
Solid waste consisting of:
Newspapers.
Corrugated cardboard.
Glass.
Tin and aluminum cans.
Plastic bottles which are either polyethylene terephthalate (PETE) and/or
high-density polyethylene (HDPE). These normally have a recyclable symbol
on the bottom with Number 1 or 2.
Tires.
White goods, which are defined as appliances and large solid metal items,
including but not limited to washers, dryers, refrigerators, freezers, stoves,
water tanks, hotwater heaters, air conditioners, vending machines, copy machines,
axles, transmissions, tire rims, metal tubs and shower stalls.
Includes all garbage, refuse, rubbish and waste.
A.Â
It shall be mandatory for all persons to separate recyclables
from all other solid waste produced in, disposed of or left for collection
or disposal within the Town of Philipstown.
B.Â
No person shall dispose of solid waste containing recyclables
at the Town of Philipstown Landfill or at any facility owned or operated by
the Town of Philipstown.
C.Â
No person shall collect and dispose of solid waste within
the Town of Philipstown which contains recyclables.
D.Â
Disposal; regulations:
(1)Â
It shall be mandatory for all persons to dispose of recyclables
within the Town of Philipstown either by.
(a)Â
Arrangement with a firm having a valid collector's
license issued by the town or the Village of Cold Spring or the Village of
Nelsonville;
(b)Â
Arrangement with a firm having a contract with the town
or the Village of Cold Spring or the Village of Nelsonville for the purpose
of disposing of recyclables; or
(c)Â
Disposing of the same at a location designated by the
town.
(2)Â
The Town Board of the Town of Philipstown may adopt regulations
governing the foregoing.[1]

Solid waste generated within any municipality may not
be disposed of at the Town of Philipstown Landfill or at any facility owned
or operated by the Town of Philipstown unless said municipality has implemented
a mandatory recyclables recovery program.
Any person who violates or neglects to comply with any provision of
this article, or any regulation promulgated hereunder, shall be guilty of
a violation punishable as follows:
A.Â
The Town Board of the Town of Philipstown is authorized
to adopt and establish regulations by resolution for the administration, procedures
and manner of collection and disposition of recyclables under this article.
B.Â
The Town Board may adopt, amend, modify or supplement
said regulations by resolution.

If any section, paragraph or provision of this article is adjudged to
be invalid, the effect of such decision shall be limited to the section, paragraph
or provision expressly stated in the decision to be invalid, and all other
sections, paragraphs or provisions of this article shall continue to be valid
and fully effective.
