The Town Board, by majority vote, shall be authorized
to release or return to any insured any amounts which it would otherwise
be entitled to claim as fire insurance proceeds pursuant to tax liens,
provided that the insured agrees, in writing, to restore the effective
premises to the same or improved condition that it was prior to the
time that the lien of such district against proceeds, provided for
under § 22 of the General Municipal Law, arose subject to
such condition as such resolution shall provide to guarantee performance
of such obligations, including but not limited to an agreement to
deposit such proceeds in an escrow account or that the insured shall
obtain a performance bond.
