There is hereby established in the Township a State Uniform Construction Code enforcing agency, consisting of a Construction Official, Electrical Subcode Official, Building Subcode Official, Plumbing Subcode Official, Fire Protection Subcode Official and such other Subcode Officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency.
The State Uniform Construction Code, as part of the New Jersey Administrative Code, is hereby adopted by the Township of Robbinsville and made a part hereof as if set forth herein in full. All rules and regulations set forth therein shall be applicable to the Township as modified by the Code of the Township where permissible. Copies of the State Uniform Construction Code are available in the Municipal Building in the office of the Construction Code Official and may be reviewed there. No person may perform plumbing work requiring a permit unless licensed by the State of New Jersey to do so except a homeowner working on his/her own single-family dwelling.
Each official position created in subsection 11-1.2 hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217 (N.J.S.A. 52:27D-119 et seq.), as amended, and N.J.A.C. 5:23, provided that, in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217, and N.J.A.C. 5:23 to hold each such position.
The public shall have the right to do business with the enforcing agency at the Municipal Building, Route 130, Robbinsville, New Jersey 08691.

A. 
Pursuant to the legislative intent of Chapter 217 of the Laws of New Jersey 1975 (N.J.S.A. 52:27D-119 et seq.) and guidelines promulgated by the New Jersey Department of Community Affairs under Title 5, Chapter 23, of the New Jersey Administrative Code, the fee schedule as set forth in Chapter 109, Fees, is hereby adopted.
B. 
Waiver of certain fees.
(1) 
The Township fees associated with single-family owner-occupied homes for siding, reroofing, and the installation of hot water heaters and furnaces may be waived for people 64 years of age and older.
(2) 
The Township fees associated with those improvements to provide accessible items for those who are physically challenged are hereby waived for owner-occupied single-family residential homes. Only the areas altered, remodeled, or rehabilitated for accessible construction shall apply.
(3) 
Fees for the State of New Jersey, known as ”DCA training fees,” shall be paid by the homeowners or their agents at time of permit issuance.
(4) 
The Construction Official may deny waiver of fees if proof of residence, age of individual or scope of work does not meet the above criteria or the definition and criteria of the UCC Barrier Free Subcode, N.J.A.C. 4:23-7.
The Construction Official shall, with the advice of the subcode officials, prepare and submit to the governing body, biannually, a report recommending a fee schedule based on the operating expenses of the agency and any other expenses of the municipality fairly attributable to the enforcement of the State Uniform Construction Code Act.
A. 
Pursuant to Chapter 217 of the Laws of New Jersey 1975 (N.J.S.A. 52:27D-119 et seq.) and Title 5, Chapter 23, of the New Jersey Administrative Code, in order to provide for the training, certification and technical support programs required by the Uniform Construction Code Act and the regulations, the enforcing agency shall collect, in addition to the fees specified above, the state surcharge fee as per the current state building permit fee schedule. The surcharge fee shall be remitted to the Bureau of Housing Inspection, Department of Community Affairs, on a quarterly basis for the fiscal quarters ending September 30, December 31, March 31 and June 30 and not later than one month next succeeding the end of the quarter for which it is due. In the fiscal year in which the regulations first become effective, the fee shall be collected and remitted for the third and fourth quarters only.

B. 
The enforcing agency shall annually, at the end of each fiscal year and not later than July 31, report to the New Jersey Bureau of Housing Inspection the total amount of the surcharge fee collected in the fiscal year. In the fiscal year in which the regulations first become effective, the report shall be for the third and fourth quarters only.
The Township of Robbinsville shall utilize the Mercer County Construction Board of Appeals.
