For purposes of this chapter, the following terms shall have the meanings indicated:
ENGINE BRAKE RETARDER
Add-on engine-brake system utilized by trucks with diesel engines.

It shall be unlawful for the owner or operator of any truck to utilize unnecessarily engine brake retarders along the entire length of Water Street and Church Road, on Kutztown Road between Church Road and Pottstown Pike, and on School House Road between Church Road and Pottstown Pike.

The acquisition and posting of appropriate signage giving notice of such prohibition is hereby authorized.
Unless another penalty is expressly provided by the Vehicle Code (75 Pa.C.S.A. § 101 et seq.), any person or legal entity violating the provisions of this chapter shall, upon summary conviction before a Magisterial District Judge, pay a fine of not less than $15 nor more than $600, together with costs of suit, collectible in the manner provided by law. Each violation after notice of an offense or service of a summons shall constitute a distinct and separate offense.
