The Township adopts this chapter pursuant to the Amusement Games Licensing Law, P.L. 1959, c. 109, effective November 3, 1959, codified at N.J.S.A. 5:8-78 et seq., as the State Legislature may amend the law from time to time and in conformance with the Rules and Regulations promulgated by the Legalized Games of Chance Control Commission in conformance with this statute.

As used in this chapter, the following terms shall have the meanings indicated:
PARK
Any place of amusement operated upon a lot or plot of ground in the open air, permanent in its nature and operated by private enterprise for profit during the entire year or any part thereof, whether admission is charged to enter or not.
A. 
No person shall operate, for gain or reward, any park, theater for plays or moving pictures, dance hall, show, exhibit, performance, play, concert of music, dancing, game, trick, juggling, sleight of hand, acrobatics, circus, theatricals, moving pictures or other amusement of any description or show any beast, bird menagerie or any curiosity of nature or art, without first obtaining a license for that purpose.
B. 
No person having the possession or care of any building or premises within the Township shall permit any such amusement to be carried on upon his/her premises for any price, gain or reward without a license.
The Township Clerk shall issue an amusement license upon application, pursuant to the provisions of § 45-1, and the payment in advance of the license fee.
Fees for amusement licenses for each calendar year, or fraction thereof, shall be as set forth in Chapter 91, Fees, § 91-3A.
A. 
Exempt organizations. Baseball, football and basketball games, entertainments or lecture courses by civic bodies and fire companies of the Township, and entertainments or lecture courses, the expense of which are guaranteed by residents of the Township, are excepted from the requirements of this chapter.
B. 
Charitable or religious organizations. This chapter shall not apply to any of the amusements enumerated when the net proceeds are for the benefit of any charitable or religious organization located within the Township or when given by the pupils of any school in the Township, the proceeds of which are to be used for educational purposes.
The Township Council may, by resolution, adopt terms, conditions, restrictions, limitations, rules and regulations governing the premises for which any such license may be issued, or for the conduct of such enumerated activities.

If ever a conflict arises between this chapter and state law or regulation pertaining to the licensing of amusement devices, the state law or regulation controls and the conflicting section of the Township Code becomes void with no legal effect.
