Editor's Note: This chapter also superseded former Ch. 84, Drug-Free
Zones, adopted 12-14-1994 (§ 4-8 of the 1994 Code), as amended.
As used in this chapter, the following terms shall have the meanings
indicated:
A drug-free school, public park and public building zone map produced
by the Township Engineer, which will indicate specific Township public schools,
public parks and public buildings used for such purposes and the area on or
within 1,000 feet of the public school or within 500 feet of such public park
or public building.
Any and all buildings within the Township of Springfield designated
by the Township Council as a building owned or leased by the Township of Springfield
available for public use.
Any and all property within the Township of Springfield designated
by the Township Council as available for recreational purposes, including,
but not limited to, Juliustown Park and the Township park adjacent to the
municipal building.
Any and all property within the Township of Springfield designated
by the Township Council as a public school, including, but not limited to,
Springfield Township Elementary School on Jacksonville-Jobstown Road.
A.
Maps produced by the Township Engineer are hereby approved
and adopted as official findings and record of the locations and areas within
the Township of Springfield which are used for public parks and public buildings
and which are owned or leased by the Township and of areas on or within 500
feet of such public park or public building. Said maps are titled "Public
Building and Public Parks 500 Safety Zone" and dated January 18, 2005, and
noted as drawing #35-1000B and #35-1000C.
B.
A map produced by the Township Engineer is hereby approved
and adopted as an official finding and record of the location and area within
the Township of Springfield which is within 1,000 feet of a public school
annexed as the "Drug Free Zone Maps" approved and adopted pursuant to this
chapter shall constitute an official finding and record as to the location
of boundaries of the areas on or within 500 feet of the property owned or
leased to the Township and used as public parks and public buildings and within
1,000 feet of a public school until such time, if any, that this chapter shall
be amended to reflect any additions or deletions with respect to the location
boundaries of the public parks, public buildings and public school and the
drug-free zone. Said map is dated November 30, 2004, and noted as drawing
#35-1000A.
C.
The Clerk of the Township is hereby directed to receive
and to keep on file the original maps approved and adopted pursuant to this
chapter and provide at a reasonable cost a true copy thereof to any person,
agency or court which may from time to time request such a copy, along with
a certification that such copy is a true copy of the map approved and adopted
herein and kept on file. It is hereby further directed that a true copy of
the map and this chapter shall be provided without cost to the Clerk of Burlington
County and the Office of the Burlington County Prosecutor.
D.
It is understood that the maps approved and adopted pursuant
to this chapter were prepared and intended to be used as evidence in prosecutions
arising as a result of the violation of this chapter, and such maps shall
constitute prima facie evidence of the following:
(1)
The location of all public parks, public buildings and
public schools within the Township;
(2)
The boundaries of the public parks, public buildings
and public schools;
(3)
The location of boundaries and areas which are on or
within 500 feet of such public parks and public buildings and 1,000 feet of
public schools.
