A.
The Town Board of the Town of Monroe recognizes that,
from time to time, the Town Supervisor may be unable to exercise the
powers and duties of that office due to the Town Supervisor's absence
from the Town or as the result of illness. The Town Board believes
that it is important to the citizens of the Town of Monroe to have
the work of the Town continue when the Town Supervisor is unavailable
due to absence or illness. Further, the Town Board believes that,
as the duly elected officials of the Town, the responsibility for
the administration of the Town's affairs rests with the Town Board
and that the duties of the Town Supervisor should be performed by
a member of the Town Board so designated by the Board when the Town
Supervisor is unable to perform his/her duties. Thus, it is the intent
of this article to provide for the designation of a member of the
Town Board to act in place of, and in lieu of, the Town Supervisor
when the Town Supervisor is unable to perform his/her duties due to
absence from the Town or illness.
B.
It is the intention of the Town Board, through the
enactment of this article and pursuant to the authority of §§ 10
and 22 of the Municipal Home Rule Law, to supercede the provisions
of § 42 of the Town Law with regard to the appointment of
a deputy supervisor.

The Town Board of the Town of Monroe is hereby
authorized to designate one of its members as the Acting Supervisor
of the Town whose duties shall include all of the powers and duties
of the Town Supervisor as contained in § 29 of the Town Law of
the State of New York. The Acting Supervisor shall be appointed by
a majority vote of the total membership of the Town Board at the Board's
initial meeting in January of each year or as soon thereafter as is
reasonably practicable. The Town Board member designated as Acting
Supervisor shall receive such compensation as the Town Board shall
authorize. The Town Board may also, by resolution, direct the person
holding the office of Acting Supervisor to perform such duties as
the Board shall determine. If compensation is provided to the person
serving as Acting Supervisor for such service, the Acting Supervisor
shall detail the number of hours biweekly he or she performs the duties
required by this section and by any such resolution(s) of the Town
Board. Such statement of hours shall be filed with the Town Clerk.
No such resolution of the Town Board directing the performance of
any particular duty or duties shall abolish, transfer, or curtail
any power of an elective officer. Nothing shall preclude, however,
the adoption of a local law to so abolish, transfer, or curtail such
power pursuant to the provisions of law, including but not limited
to § 23(2)(f) of the Municipal Home Rule Law.
