Pursuant to the General Municipal Law of the State of New York § 72-j(5), the Village of Monroe and the Town of Monroe shall jointly maintain and operate specific permit parking areas hereinafter set forth.
The designated areas of these permit parking lots shall be located on the north side of Millpond Parkway and on the easterly side of Spring Street, the Millpond Parkway parking lot being an area presently used for municipal parking containing approximately 104 parking spaces and the area on Spring Street being an area presently used for municipal parking containing approximately 28 parking spaces.
The said parking lots shall be devoted exclusively, under a permit system, to the residents of the Village of Monroe and the Town of Monroe; under a joint agreement and resolution with the Town of Monroe, parking in these areas shall be by permit only, limited to the residents of the Village of Monroe and the Town of Monroe.
Permits shall be issued to residents of the Village of Monroe and the Town of Monroe on an annual basis covering the fiscal year from June 1 to May 31 of the following year. Permits shall be issued on a first come, first served basis and the Village of Monroe and Town of Monroe reserve the right to deny a permit to anyone after all parking spaces in the designated areas have been duly allocated. The applicant, upon due proof of residence to the Village Clerk of the Village of Monroe shall be issued such permit which must be exhibited at all times in full view on the vehicle's front windshield adhering thereto. The permit may be secured during regular office hours in the Village Hall of the Village of Monroe.
The fee for such permit shall be $12 per annum, per vehicle, payable to the Village of Monroe.
The Town of Monroe shall not be liable for or responsible for the safekeeping of any vehicles or any damages whatsoever that may be done to any vehicles or arising from the parking of any vehicles in the designated permit parking areas herein. Parking, therefore, in such areas shall be at the applicant's own risk.
The designated areas and parking therein, pursuant to this article, shall be subject to continuous rules and regulations governing the operation and maintenance of such parking areas as set forth by the Village of Monroe and Town of Monroe, from time to time.
Violation of this article shall subject the violator to a penalty of not less than $5 nor more than $50 for each separate violation. In addition, the Village of Monroe and the Town of Monroe shall have the authority to remove any violating vehicle from the designated parking areas by having said vehicle towed away. The towing charges shall be charged to the violator, in addition to any other penalty set forth herein.
As used herein the term "resident of the Town of Monroe" shall mean any person, whether or not he is over the age of 18 years, who maintains or occupies a fixed, permanent and principal home in the Town of Monroe, including the Village of Monroe but excluding the Village of Kiras Joel and the Village of Harriman, and to which he, wherever temporarily located, always intends to return.
