A. 
The President and Secretary of The Board of Commissioners of Cheltenham Township are hereby authorized to execute the Intergovernmental Cooperation Agreement and any other agreements necessary for its participation in the Delaware Valley Municipal Health Insurance Cooperative. The Intergovernmental Cooperation Agreement is attached hereto as Exhibit A and incorporated herein by reference.
B. 
The agreement attached hereto is on file for inspection and review at the Office of the Township Manager, 8230 Old York Road, Elkins Park, Pennsylvania, 19027. The agreement attached hereto may be subsequently modified or amended, but in no event shall such amendments or modifications materially and adversely affect the right of Cheltenham Township to participate in the Delaware Valley Municipal Health Insurance Cooperative.
Participation of Cheltenham Township in the Delaware Valley Municipal Health Insurance Cooperative is authorized for the purpose of studying the feasibility of creating a municipal health insurance trust and taking such action as is necessary to create the trust if it is feasible to do so.
As set forth in the Intergovernmental Cooperation Agreement and as otherwise stated herein, the following conditions apply to the participation of Cheltenham Township in the Delaware Valley Municipal Health Insurance Cooperative:
A. 
That each participating municipality must meet the admission and eligibility requirements set forth therein;
B. 
That each participating municipality agrees to pay all contributions when due as provided in the Intergovernmental Cooperation Agreement and any bylaws thereafter adopted by the Cooperative;
C. 
That each participating municipality uses its best efforts to provide appropriations for the payment of any contributions required to achieve the purposes and objectives of the Cooperative;
D. 
That each participating municipality cooperate fully in achieving the purposes and objectives of the Cooperative;
E. 
That each participating municipality designate a Director as its representative on the Board of Directors; and
F. 
That each participating municipality comply with all other condition s of the Intergovernmental Cooperation Agreement.
That Cheltenham Township agrees to participate in the Delaware Valley Municipal Health Insurance Cooperative and thereafter may withdraw for any reason whatsoever provided that it has fulfilled all its financial obligations to the Cooperative upon withdrawal.
The effective date of the participation of Cheltenham Township in the Delaware Valley Municipal Health Insurance Cooperative will be no later than May 27, 1997.
Each participating municipality delegates to the Board of Directors of the Delaware Valley Municipal Health Insurance Cooperative the powers enumerated in the Intergovernmental Cooperation Agreement and bylaws.
All contributions paid by Cheltenham Township shall be made with funds appropriated by Cheltenham Township for that purpose.
The organizational structure of the Cooperative shall consist of a Board of Directors and an Executive Committee selected by the Board of Directors in accordance with the Intergovernmental Cooperation Agreement and bylaws.
The funds required for the operation of the Cooperative shall be provided by the participating municipalities through annual appropriations.
The Delaware Valley Municipal Health Insurance Cooperative is empowered to enter into contracts for policies of group insurance and employee benefits, including social security for any of its employees.
As a condition of participating in the Delaware Valley Municipal Health Insurance Cooperative, Cheltenham Township agrees to comply with all the terms and conditions in the attached Intergovernmental Cooperation Agreement.
This article is being enacted pursuant to the provisions of Intergovernmental Cooperation Law, Act of July 12, 1972, No. 180, as amended, 53 Pa. C.S.A. § 2301 et seq.
