As used in this chapter, the following terms
shall have the meanings indicated:
Any felt tip marker, china marker or similar device that
is not water soluble and which has a flat or angled writing surface
of 1/2 or greater.
Any person under the age of 18 years.
Any retail establishment.
A.
No person shall sell or otherwise transfer any spray
paint container or indelible marker to a minor, unless the minor is
accompanied by his or her parent or legal guardian at the time of
the purchase or transfer.
B.
No minor shall, at the time of purchase of items specified in Subsection A above, knowingly furnish fraudulent evidence of maturity, including, but not limited to, a motor vehicle operator's license, a registration certificate issued under the Federal Selective Service Act, an identification card issued to a member of the armed forces or any document issued by a federal, state, county or municipal government.
C.
It shall be unlawful for any person under the age
of 18 to possess an open, uncapped or broken capped spray paint container
or undilutable marker upon any public street, public sidewalk or public
way or any grounds owned by the City or any place to which the public
has a right of assess as invited within the limits of the City.

Any person who violates the provisions of this
chapter shall be subject to a fine or penalty of $200 for the first
offense; $300 for the second and subsequent offense within a one-year
period.
