A. 
Any user who is found to have violated an order of the Town Commissioners or who willfully or negligently failed to comply with any provision of this Part 2 and the orders, rules, regulations and permits issued hereunder shall be fined for each offense in accord with the following schedule:

(1) 
Violation of discharge limitations:
(a) 
$1,000 per day.
(b) 
In addition, an additional fine to cover all penalties and/or fines and costs incurred by the Town as a result of the violation, up to $5,000 per day of said violation.
(2) 
Failure to comply with implementation schedule:
(a) 
$100 per day past schedule.
(b) 
In addition, all costs incurred by the Town as a result of said failure, up to $5,000 per day.
(3) 
Reporting requirements:
(a) 
Failure to submit written schedules: $50 per day.
(b) 
Failure to submit written report: $50 per week.
(c) 
Failure to notify of discharge of prohibited materials: $50 per day in addition to the fines listed under Subsection A(1) above.
(4) 
All other offenses: $1,000 per day.
B. 
Each day on which a violation shall occur or continue shall be deemed a separate and distinct offense.
C. 
In addition to the penalties provided herein, the District may recover reasonable attorneys' fees, court costs, court reporters' fees and other expenses of litigation by appropriate suit at law against the person found to have violated this Part 2 or the orders, rules, regulations and permits issued hereunder to the extent authorized by law.
Any person who knowingly makes any false statements, representation or certification in any application, record, report, plan or other document filed or required to be maintained pursuant to this Part 2 or wastewater contribution permit or who falsifies, tampers with or knowingly renders inaccurate any monitoring device or method required under these regulations shall, upon conviction, be subject to the penalties prescribed by law.
