It is hereby declared to be the purpose of this chapter to regulate the closing hours of retail businesses within the CBD-2 Zone in order to avoid the noise, lights, inconvenience and disturbance to residential properties which are caused when retail establishments remain open during the late evening hours. It is also hereby declared to be the purpose of this chapter to regulate the hours of such retail establishments in order to avoid loitering and crime during the late evening hours. It is hereby declared and determined to be in the best interest of the health, safety and welfare of the residents of the Borough of Madison that retail businesses cease the conduct of their business at a reasonable hour.
As used in this chapter, the following terms shall have the meanings indicated:
RETAIL BUSINESS
Includes any for-profit business which holds itself out to the general public for the sale at retail of goods and services, but excluding bank automatic teller machine operations.
Every retail business within the CBD-2 Zone of the Borough of Madison shall be closed to the public and business with the public therein shall be and is hereby prohibited after the hour of 11:00 p.m. and before the hour of 7:00 a.m. on Sunday through Wednesday, and after the hour of 12:00 a.m. and before the hour of 7:00 a.m. on Thursday, and after the hour of 1:00 a.m. and before the hour of 7:00 a.m. on Friday and Saturday.
