A. 
Except as otherwise provided, provisions of this chapter shall be enforced by the Madison Superintendent of Public Works. The Superintendent may delegate said enforcement responsibilities to one or more employees of the Borough of Madison as deemed necessary and appropriate for effective enforcement.
B. 
Random inspections of garbage set out for collection can be conducted in order to determine if recyclable materials are included.

The provisions of Article VI, Medical Waste, shall be enforced by the Madison Health Officer. The Health Officer may delegate said enforcement responsibilities to one or more employees of the Borough of Madison as deemed necessary and appropriate for effective enforcement.
Any person, corporation, occupant, or entity that violates or fails to comply with any provision of this chapter or any of the rules and regulations promulgated hereunder shall, upon conviction thereof, be punishable by a fine not less than $25, nor more than $1,000. Each day such violation shall be continued shall be deemed to be a separate and distinct offense.
The Superintendent of Public Works and the Recycling Coordinator are hereby authorized and directed to promulgate such reasonable regulations as necessary for the efficient operation of the solid waste and recycling collection programs, respectively, including but not limited to the manner, days and times of collection. Said regulations may also establish reasonable exceptions from the recycling requirements, such as for physically disabled or handicapped persons. Such regulations shall take effect only after adoption by resolution of the Borough Council. Such regulations may be amended from time to time by the same procedure as deemed necessary and appropriate.
