It shall be unlawful for any owner, possessor or occupant of lands in the Borough of Madison to store, keep, place, park or accumulate upon such lands any motor vehicles, automobiles or machines so in need of repair as not to be readily operated under their own power, requiring substantial repairs, not currently licensed or not being currently used for transportation, except as hereinafter provided.
It shall be unlawful for any persons to park, leave standing or abandon any machines, motor vehicles or automobiles so in need of repair as not to be readily operated under their own power, which require substantial repair, which are not currently licensed or which are not being currently used for transportation on the land of another.

A. 
This chapter does not apply to an owner, possessor or occupant of lands in the Borough of Madison who stores, keeps, places, parks or accumulates:
(1) 
No more than one licensed or unlicensed motor vehicle, automobile or machine not currently being used for transportation and being in need or repair; provided, however, that the repairs upon any such motor vehicle, automobile or machine is completed within 90 days of the date that said vehicle, automobile or machine was first parked, left standing or abandoned upon said property.
(2) 
Any licensed or unlicensed motor vehicle, automobile or machine not currently being used for transportation and being in need of repairs, provided that same is kept in an enclosed building.
B. 
This chapter does not apply to a new car dealer or used car dealer licensed by the State of New Jersey to sell new and/or used cars.

The Zoning Officer of the Borough of Madison, police officers of the Borough of Madison or such other person as shall be duly authorized by the Borough Council shall be responsible for the enforcement of this chapter.

Any person, firm, corporation or other organization found guilty of violating any provision of this chapter shall, upon conviction thereof, be punishable by one or more of the following in the discretion of the Judge: a fine of not to exceed $2,000; or by imprisonment for a term not exceeding 90 days; or by a period of community service not exceeding 90 days. In the event that a fine is imposed, pursuant to this section, such fine shall be no less than $100.
