A certain document, three copies of which are on file in the office of the Township Clerk of the Township of South Hackensack being marked and designated as the “2009 International Property Maintenance Code,” as the same may be amended from time to time, be and is hereby adopted as the Property Maintenance Code of the Township of South Hackensack for the control of buildings and structures as herein provided. Each and all of the regulations, provisions, penalties, conditions and terms of said code are hereby incorporated herein and made a part hereof as if the same were more fully set forth herein this chapter with the additions, insertions, deletions and changes, if any prescribed in § 167-2 hereinbelow.

The aforesaid 2009 International Property Maintenance Code, as the same may be amended from time to time, is amended and revised in the following particular respect:
A. 
The jurisdiction referred to therein is the Township of South Hackensack.
B. 
The penalty provided in Section PM-106.2 shall include a minimum fine of $50, a maximum fine of $2,000 or a period of community service not to exceed 90 days or imprisonment for a term not to exceed 90 days, or any combination thereof.

C. 
The period during which screening and self-closing doors are required on certain premises under Section PM-304.12 shall be from June 1 until October 31 of any year.
D. 
The periods during which certain heating of premises is required in Section PM-602.2.1 and Section PM-602.3 shall be the same as provided in the Health Code of the Township of South Hackensack.

A. 
Definition. For purposes of this section, "graffiti" means any drawing, painting or the making of any mark or inscription on any public or private real or personal property without the written permission of the owner of the property.
B. 
Removal. The Township may require any owner to remove, within 90 days of written notification (120 days in the case of the Department of Transportation), any graffiti as the same is defined hereinabove.
C. 
Form of notice. Said notice shall be in writing and forwarded to the property owner of record via certified mail or by personal delivery. Said notice shall contain a provision requiring that the property owner sign the notification and return the same within the above-stated time frames indicating that the graffiti has been removed. Said provision shall state that by signing the same the owner is certifying under penalty of perjury that the graffiti has been removed.
D. 
Objection to removal. Any owner receiving notice as described in this section shall also within said notice be advised that he or she may inform the Township in writing within 30 days that he or she objects to the removal of the graffiti. Said notice shall be delivered personally or sent via certified mail. Said owner shall thereafter have the right to institute an action in any court of competent jurisdiction within 60 days of said notice objecting to the order of removal.
E. 
Failure to remove. If the property owner fails to object or remove the graffiti within the time frames set forth above, then the Township and/or its agents may undertake to remove the same and assess the costs of said removal against the owner and provide an itemized bill for the same. If the same is not paid, the Township may place a municipal lien against the property for said costs together with any interest and may authorize the institution of an action for collection of the same.

A. 
Appointment and term. The Township Committee may appoint a Property Maintenance Officer(s) and establish hours for said position. The term of said appointment(s) shall commence upon appointment by the Township Committee and shall terminate on December 31 or at such time that their successor(s) are appointed.
B. 
Duties. The Property Maintenance Officer shall be entrusted with the enforcement of the 2009 International Property Maintenance Code, as the same may be amended from time to time, as set forth in § 167-1 above.

C. 
Compensation. The Property Maintenance Officer shall receive such compensation as set by the Township Committee in the Salary Ordinance.
