No person, company or entity shall place or cause to be placed gas pipeline(s) upon, over, through or under the county roads and highways of Buchanan County, Virginia, without first obtaining a land use permit from the County Building Inspector upon express approval by the Buchanan County Board of Supervisors. Applications for such permit shall contain all technical information that the applicant has submitted to state and federal regulatory agencies, including but not limited to a plat of the exact pipeline location, a traffic control plan and an engineer's certification stating that the application plans meet all requirements that are imposed by the Virginia Department of Transportation for installing similar pipelines upon, over, through or under state roadways.
A. 
An application and site inspection fee of $500 is required for each application, and each pipeline shall require a separate application and fee. Violation of this chapter shall constitute a misdemeanor with a penalty not to exceed 12 months in jail and a fine not to exceed $1,000 for each day of violation. Such criminal charges may be pressed against any person involved in the pipeline installation, including those persons deemed to have authorized such installation.
B. 
In addition, civil penalties not to exceed $10,000 per day may be imposed by Buchanan County by filing of a petition in a court of competent jurisdiction.
