A.
In accordance with Chapter 111, § 31, of
the Massachusetts General Laws, and in order to further clarify the
State Environmental Code, Title V, Subsection 310, CMR 15.303 Septic
Systems Failing to Protect the Public Safety and the Environment,
the Board of Health hereby adopts this article.
B.
Also, the possible contamination to the environment
by substandard on-site sewage disposal systems presents a serious
threat to public health. In addition, these systems may pose a threat
to the sole source aquifer and/or areas designated as wetlands affecting
the environment and public health.
This regulation is adopted pursuant to the power
of the Board of Health conferred by Chapter 111, § 31, of
the General Laws: Septic systems consisting of one cesspool shall
be upgraded to conform to 310 CMR 15.00, the State Environmental Code,
Title V, Minimum Requirements for the Subsurface Disposal of Sanitary
Sewage, and the Town of Barnstable Board Health regulations.[1]

Editor’s Note: Former § 360-9.1, Upgrading systems
consisting of leaching pit with high liquid level, added 2-19-2008,
as amended, which immediately followed, was repealed 3-20-2018.
This regulation shall apply to any septic system
inspection conducted in accordance with 310 CMR 15.301 of the State
Environmental Code, Title V.
This regulation shall also be strictly enforced
during the building permit application process.
