The Barnstable Board of Health reserves the right to make any decision
of situations or problems that arise in regard to health or housing conditions
that are not covered by this set of regulations.
Under MGL c.111, § 157, anyone who violates the provisions
of these regulations shall be punished by a fine of $5 for each day such violation
continues. This regulation and any guidelines and orders may be enforced pursuant
to the provisions of MGL c.40, §§ 21 and 21D. The fine for
any violation of this regulation shall be $100 per violation. Each day shall
constitute a separate violation with the same fines assessed as per this section.
The Barnstable Board of Health also reserves the right, in addition
to any other enforcement actions, to suspend or revoke licenses previously
issued and abate violations at the stable owner’s expense if continued
violations of these regulations occur.
