[HISTORY: Adopted by the Township Council (now Township Committee) of the Township of Oxford 9-2-1975 (Ch. 65 of the 1974 Township Code). Amendments noted where applicable.]
Except as provided in § 203-3, it shall be unlawful for any person or persons to carry on or conduct the business of hawker, peddler, scavenger, itinerant vendor of merchandise, itinerant magazine solicitor or subscription agent or keeper of traveling or other shows, carnivals or circuses, within the Township of Oxford, without having first obtained a license from the Township Clerk to do so.
The Township Clerk is hereby authorized to issue any such license upon the filing of an application in the form required by the Township Clerk and the payment of the proper fee as hereinafter provided, except that the payment of the fee shall not be required where the applicant is a nonprofit organization.
The following persons or organizations are hereby exempted from the provisions of this chapter:
A. 
Any charitable or religious society that shall conduct sales of personal property when the proceeds thereof shall be applied to the payment of the expenses thereof and to the charitable or religious object for which the society exists.
B. 
Any person honorably discharged from the military services of the United States, possessing a peddler's license issued in conformity with N.J.S.A. 45:24-9 and 10.
C. 
Any person who is an exempt fireman of a volunteer fire department, as defined in N.J.S.A. 45:24-9 and 10, possessing a license in conformity with said law.
D. 
Any public utility or its employees, which said public utility is subject to regulation by the State Board of Public Utility Commissioners; provided, however, that such employees shall display the identification badge or card issued by their employer.
E. 
Any person selling fruits and farm products grown by himself, with or without the help of others.
F. 
Any person engaged in the delivery of goods, wares or merchandise or other articles or things, in the regular course of business, to the premises of persons who had previously ordered the same or were entitled to receive the same by reason of a prior agreement.
In addition to any other information required to be provided by this chapter, except for the nonprofit organizations and any other persons excepted from the requirements of this chapter, all applicants shall have their fingerprints taken and recorded by a qualified member of the Oxford Township Police Department prior to the issuance of the license.
Every license shall remain in force and be valid only for the time therein expressed, shall apply only to the person or persons to whom granted and shall not be transferable. All yearly licenses shall run from January 1 of the year in which the license is issued. The full fee for the time opposite the classification in § 203-8 shall be paid for each license granted to any person or persons under that classification, and no pro-rata reduction in the fees shall be made nor shall a refund be made because of cessation of business after such license shall have been issued.
Any person or persons to whom a license is granted as herein provided is/are hereby required to exhibit such license in a conspicuous place on the side of his vehicle.

All persons to whom a license is granted as hereinafter provided shall comply with any rules and regulations promulgated by the Township Committee and shall comply with all state laws and local ordinances; and if the licensee shall be found guilty of the violation of any state, Township or Board of Health ordinance, the license granted may be revoked by the Mayor. Notice of revocation, in writing, signed by the Mayor and the Township Clerk, served on the licensee, shall be considered a revocation of the license.

A. 
The license fees under this chapter shall be as follows:
(1) 
Amusements.
(a) 
Circuses or wild west shows, under canvas, per day: $25.
(b) 
Carnivals, per day: $25.
(2) 
Peddling. Hucksters, hawkers, vendors or peddlers who sell on the streets, from a vehicle of any kind, fish, ice cream, vegetables or other farm products except of their own raising, meats, bread or other food supplies, and who have no licensed place of business in the Township of Oxford, per year: $50.
(3) 
Itinerant hawkers, vendors or peddlers. Every itinerant hawker, vendor or peddler selling souvenirs, novelties, balloons, badges, toys, etc., or conducting amusement or refreshment stands on holidays, parade days, circus days or other times, per day: $50.
(4) 
Traveling or transient agents selling or soliciting orders, from house to house, from catalogue or sample, for any merchandise, books, magazines, periodicals, study courses, etc., having no licensed place of business in the Township of Oxford, per day: $50.
B. 
Fees for employees. The provisions of § 203-8A governing peddling, vending and traveling and transient agents shall apply to principals only; and in cases where assistants, agents or employees are engaged, it shall be necessary for each agent, assistant or employee to secure the "under peddlers license" at a fee of $50 per year, the same to bear on the face of it the name of the principal under which the holder operates.
Any permit secured by misrepresentation or error shall be revoked, and the offender shall be subject to the penalties of this chapter.

Each and every person violating any of the provisions of this chapter shall, upon conviction thereof, forfeit and pay a fine of not more than $1,000 or be imprisoned in the county jail for not more than 90 days, and the Judge before whom any such person may be brought may impose such punishment by fine and imprisonment in the County Jail as he may see fit, not exceeding the maximum herein fixed.
