As used in this article, the following terms
shall have the meanings indicated:
Interfering with the free and lawful passage of pedestrians
and vehicles on sidewalks in the Township by placing thereon any structures,
posts, poles, goods, wares, merchandise or other articles of trade
or sale, or in any other manner whatsoever.
The concrete, asphalt, flagstone, pavers, slate or established
walks between the traveled roadway and the adjacent property line.
A.
Snow and ice. The owner, occupant or tenant of any
premises abutting or bordering upon any public street in the Township
shall remove all snow, slush, sleet or ice from on and along the abutting
sidewalks of such streets, avenues or highways or, in the event of
sleet or ice which may be so frozen as to make removal impractical,
shall cause sand or rock salt to be spread on the icy surfaces of
the sidewalk within 24 hours after the sleet shall fall or ice be
formed.
B.
General maintenance. The owner, occupant or tenant
of any premises abutting or bordering upon any public street in the
Township shall at all times keep the abutting sidewalks of such streets,
avenues or highways free from all weeds, limbs and branches of trees
or shrubs, holes, pits, loose stones, rubbish, paper, debris and other
objects and shall keep said sidewalks free from obstructions of any
nature.
C.
In the event that the building is occupied by more
than one family or business unit, then the owner of said building
is hereby required to undertake the obligations with respect to clearance
and maintenance of the sidewalk set forth hereinabove.
All trees and shrubs that stand along sidewalks,
the branches of which extend over any part of a sidewalk, shall be
trimmed by the owner, occupant or tenant of any premises which abuts
or borders upon that part of the sidewalk along which the trees or
shrubs stand. Such owner, occupant or tenant shall keep the branches
and limbs of such trees or shrubs trimmed and cut so that no limb
or branch shall overhang the sidewalk at a height of less than eight
feet above ground level.
This article shall not apply:
A.
Where the obstruction is caused by the loading or
unloading of goods, wares, furniture or merchandise to and from vehicles
in such a manner as to cause a minimum of obstruction which is necessary
and unavoidable.
C.
To any owner, occupant or tenant who receives consent
from the Township Committee for such reasons granted.
A.
Whenever a violation of this article is found with
respect to any property situate within the Township, notice, in writing,
shall be given to the owner, occupant or tenant thereof to remove
or abate same within 24 hours from service thereof. A duplicate of
the notice shall be left with one or more of the tenants or occupants
of the premises or place.
B.
If the owner resides out of the state or cannot be
so notified speedily, such notice shall be left at that place or premises
with the tenant or occupant thereof, or posted on the premises, and
such action shall be considered proper notification to the owner,
tenant or occupant thereof.
Any person violating or refusing or failing
to comply with the provisions of this article shall be liable to a
minimum fine of $250 and a maximum fine of up to $2,000, imprisonment
for a term not exceeding 90 days or a period of community service
not exceeding 90 days, or any combination thereof, for each offense.
The imposition of a penalty for a violation of this article shall
not excuse the violation or permit it to continue; such violation
shall be remedied within a reasonable time; and each day that such
violation is permitted to exist shall constitute a separate offense.
