The commission is hereby established which shall be known and designated
as the "Town of Rosendale Industrial Commission."
Such Commission shall consist of five members, all residents of the
Town of Rosendale, and the members of such Commission shall be appointed to
serve a single term of three years. At the expiration of such term, a member
may succeed himself or herself, upon further appointment by the Town Board.
Members of such Commission shall serve without pay.
Vacancies in such Commission occurring otherwise than by expiration
of the term shall be for the unexpired term and shall be filled in the same
manner as original appointments.
Members of the Commission shall elect from their own number a Chairman
and Secretary and other necessary officers to serve for one year and may employ
such persons as may be needed, as authorized by this chapter and pursuant
to law.
Such Commission shall be empowered to adopt rules and procedure for
the conduct of all business within its jurisdiction.
The Commission shall work in coordination and conjunction with the Planning
Board of the Town of Rosendale, but the Commission shall not abrogate nor
diminish any of the powers and duties heretofore granted to the Planning Board
by local law and pursuant to statute, nor shall the Commission act in the
place and stead of the Planning Board or its jurisdictional functions within
the local Zoning Law[1] of the Town of Rosendale.
The powers of the Commission shall include but not be limited to the
following:
A.
To initiate, seek out and attract commercial developers
for the Town.
B.
To contact people in industry and business, to create
a public relations system, to advertise, to prepare brochures and to seek
new markets for business and commercial development within the Town.
C.
To work with and advise the Planning Board in the location
and development of industrial sites within the Town.
D.
To meet with and work with consultants and other specialists
in industrial development in state, federal and county agencies.
The expenses incidental and necessary to conduct the affairs of the
Commission are hereby authorized to be paid from the general fund or, in the
alternative, from a petty cash fund herewith established for such purposes,
pursuant to the provisions and limitations set forth in § 64, Subdivision
1-a, of the Town Law, as amended in 1971.
The Commission shall continue in existence for a term of 10 years from
and after the date of the enactment of this chapter, unless sooner terminated
pursuant to the powers granted to the Town Board under the Town Law, § 51.
