The Town sanitary landfill, for purpose of dumping garbage and refuse and accepting recyclable materials, shall be known as the "Town of Rosendale Sanitary Landfill/Recycling Center" situated on Whiteport Road in the Town of Rosendale.
The use of any other lands within the limits of the Town of Rosendale, exclusive of any incorporated village therein, for dumping of garbage, trash and refuse is hereby prohibited.
A. 
Issuance of permit.
(1) 
No person shall dispose of solid waste, garbage, trash, recyclables, brush or refuse at the Town of Rosendale Sanitary Landfill/Recycling Site without first having obtained a permit from the Town. Upon approval of the application and payment of the required fee, the Town Clerk shall issue a permit, the terms of which shall be from January 1 to December 31 of the year issued.
(2) 
Permits for commercial haulers are subject to approval by the Town Board of the Town of Rosendale, and said haulers must be licensed by the County of Ulster and must provide curbside recycling pickup to their residential and commercial customers, either directly or by subcontracting a duly licensed hauler to provide this service to their commercial and residential customers.
B. 
Fees. Fees shall be determined by the Town Board of the Town, by resolution, which may revise them as it may be deemed necessary from time to time. Fees will cover all generator usages, including residential, commercial/business, institutional and commercial hauler.
C. 
Types of solid waste accepted. The Town Board shall, by resolution, determine the types of solid waste that will be accepted at said landfill/recycling center, as well as how it may be disposed of, sorted, separated, recycled, composted or prepared prior to disposal thereof.
D. 
The minimum amount of recyclables allowed in disposed solid waste is 10% by volume.
E. 
The Town Board may amend these rules and regulations from time to time, by resolution, as it deems necessary.
The use of the Town Landfill/Recycling Center shall be restricted to the dumping of solid waste, trash, garbage, refuse and/or separation of recyclables as designated, of only those materials which have originated from within the lands of the Town. All persons desiring to use this facility must obtain from the Town Clerk a permit as specified above. Every permittee shall affix the permit sticker to their vehicle, readily visible to landfill personnel, as designated by the Town Clerk or landfill personnel. The Town Supervisor or a duly designated representative can revoke any permit for misuse of landfill privileges. Said revocation can only be reversed by the Town Supervisor or a majority of the Town Board.
The Town Landfill/Recycling Center shall be open as designated by the Town Board from time to time. Entry to the site will be allowed only during these hours of operation.
A. 
A violation of any provision of this article shall constitute an offense. The enforcement officer will be the Town of Rosendale Recycling Coordinator and/or the Town of Rosendale Landfill Operator, and/or that person or persons duly designated by the Town Board of the Town of Rosendale for such purpose.
B. 
The vehicles tipping waste may be inspected by landfill personnel at the point of disposal and must not contain more than 10% recyclables by volume.
The violation of any of the provisions of this article shall constitute an offense. Any person violating any of these provisions shall be punished by a fine not to exceed $250, and the fine for each and every subsequent violation by any one person of any of the provisions of this article shall not exceed $1,000.
