Any resident, commercial/business, institution or commercial hauler within the jurisdiction of the Town may dispose of municipal solid waste at the Town of Rosendale Landfill/Recycling Center only by complying with the following requirements.
Recyclables shall be separated from all other solid waste. After adequate notice has been published, posted and publicized, it shall be mandatory for all persons who are owners, lessees or occupants of residential, commercial/business or institutional dwellings in the Town to separate recyclables for curbside collection (if contracted with commercial hauler) and/or for dropoff at the Sanitary Landfill/Recycling Center.
A. 
For the purposes of this article, preparation of recyclables is defined. These categories may be targeted by the Recycling Coordinator and/or the Town Board for future expansion or change and are subject to approval by the Town Board of the Town. The following materials must be source-separated by category and placed at curbside, if contracted with commercial hauler, in accordance with the scheduled pickup days and provisions. Self-haulers will sort materials and place them in the designated receptacles at the Town Sanitary Landfill/Recycling Center and/or any other site designated by said Town Board. No contamination of food in recyclables will be allowed; all recyclables must be prepared as specified below. (See § 58A-2 of this article for definitions of these materials.)
B. 
Required preparation of materials.
(1) 
Appliances: Shall be placed in designated area and prepared by dismantling in such a way that they will not be a hazard to the public. Doors shall be removed.
(2) 
Cans: Must be rinsed clean of contents, with paper labels removed and flattened if possible.
(3) 
Cardboard: Shall include brown corrugated cardboard, which must be flattened, bundled or nested and free of contents or packaging materials. No soiled, contaminated or coated cardboard will be accepted.
(4) 
Construction and demolition debris: Shall be prepared, sorted and separated as specified by landfill personnel. Any unacceptable forms of construction and demolition debris will otherwise be referred to a designated C and D landfill in accordance with 6 NYCRR, Part 360, Subpart 360-7.
(5) 
Glass: Must be rinsed clean of contents. Lids should be removed and discarded and labels removed if possible.
(6) 
Newsprint: Must be kept clean and dry and must be securely bundled and tied with string, twine, rope or cord sufficient in strength to facilitate handling (not to exceed 50 pounds).
(7) 
Plastic: Shall be rinsed clean of contents, with caps removed and discarded.
(8) 
Tires: Prepared as specified by landfill personnel and placed in designated area.
(9) 
Yard waste: Shall be separated from nonrecyclables and other recyclables and placed in designated area for composting, free from any nonorganic contaminants. No plastic bags or containers are allowed in the composted material.
A. 
From the time any person places any recyclable materials at or near the curb, sidewalk, street, receptacle or transfer station for the purposes of collection, those recyclable materials shall become the property of the Town of Rosendale or its authorized agent. No person who is not acting under the authority of the Town of Rosendale or its authorized agent shall collect, pick up, remove or cause to be collected, picked up or removed any recyclable materials so placed for collection. Each such unauthorized collection, pickup or removal shall constitute a separate violation of this article; provided, however, that where the authorized agent has refused to collect certain recyclables because they have not been prepared or treated in accordance with the provisions and specifications in § 58A-12 of this article, the person responsible for initially placing those materials for collection may and shall remove those materials from any curb, sidewalk, receptacle or street side.
B. 
Any commercial hauler contracted to collect recyclables shall deliver and deposit said materials to the Rosendale Landfill/Recycling Center or to such locations as the Town Board of the Town of Rosendale shall designate for that purpose.
Enforcement will be maintained by the Town of Rosendale Recycling Coordinator and/or by that person or persons duly authorized as such by the Town Board.
Fees for appliances, tires, etc., shall be determined by the Town Board of the Town, by resolution, which may be revised by it as it is deemed necessary, from time to time. Fees will cover all generator usages, including residential, commercial/business, institutional and commercial.
A. 
The first violation of this article shall result in a written warning to be dispensed at the discretion of the enforcement officer or Recycling Coordinator, with full knowledge of the Town Board, and placed on record at the Rosendale Town Hall. The offender will be given verbal and/or written instructions for source-separation and recycling.
B. 
The second violation of any provision in this article shall result in minimal fine of $25, and a maximum fine of $500. The offender will be given written instructions for source-separation and recycling.
C. 
The third violation of any provision of this article shall result in the suspension of the permit to dispose of solid waste at the Town Sanitary Landfill/Recycling Center. The minimum period of suspension will be 10 days, and the maximum period of suspension will not exceed one year, and/or a minimum fine of $100 and a maximum fine not to exceed $1,000.
