The Town Board of the Town of Rosendale hereby adopts the within article pursuant to Article 3 and the other applicable sections of the Municipal Home Rule Law of the State of New York. The purpose of this article shall be to authorize and empower the Town of Rosendale, its agents, officers and employees, to remove abandoned and junked vehicles from the real property situated within the Town of Rosendale, Ulster County, New York, and assess the expenses of such removal against the property upon which such junked vehicles are situated.
The officers and employees of the Town of Rosendale, under the direction of the Supervisor and the Town Board, may and are hereby authorized to enter upon any private lands and real property situated within the Town of Rosendale, Ulster County, New York, and remove and employ assistants, agents, servants and contractors to remove any and all junked vehicles and abandoned vehicles situated on said real property.
The costs and reasonable expenses for such removal and disposal of such vehicles shall be assessed against the owners of the real property upon which said junk and said vehicles are situated. This charge shall be added to the annual tax rolls and shall become a lien upon the real property in the same manner as the annual taxes raised by the Town of Rosendale. The expenses of removal of such junk and abandoned vehicles shall be advanced by the Town of Rosendale, and the said Town of Rosendale shall be reimbursed upon the collection of the special assessment levy.
Before the Town of Rosendale, its officers, agents, employees, servants and contractors shall go upon said land, the Town of Rosendale shall notify the property owner to remove such junked vehicles and abandoned vehicles within 30 days; and at the expiration of said 30 days, the Town of Rosendale shall then proceed to remove such abandoned and junked vehicles. The notice shall be sent to the last known owner of the real property, as listed in the current assessment rolls of the Town of Rosendale, and shall be mailed by ordinary mail to the address indicated on such rolls.
