The following words and phrases, when used in this chapter, shall have the meanings given them in this section, unless the context clearly indicates otherwise:
BOARD OF COMMISSIONERS
The Board of Commissioners of the Township; the governing body of the Township.
ENABLING ACT
The Act of January 5, 1952, P.L. (1951), § 1833, 65 P.S. § 201 et seq., including rules and regulations issued under or pursuant thereto, as such act and rules and regulations have been and may from time to time be amended.
FEDERAL REGULATIONS
The rules and regulations issued under, pursuant to and/or in connection with the Social Security Act and/or the social security program, as such rules and regulations have been and may from time to time be amended.
PLAN AND AGREEMENT
The plan and agreement as is now or may be hereafter required under the provisions of the Social Security Act and enabling act to extend social security coverage to employees and officers of the Township, with the exception of those performing certain services as may be provided in the plan and agreement, including any amendments or modifications to or any substitutions for the plan and agreement which the Board of Commissioners may from time to time deem appropriate and which are executed and delivered by the proper officers of the Township pursuant to § 72-3 of this chapter.
SOCIAL SECURITY ACT
The Act of Congress approved August 14, 1935, Chapter 531, 49 Stat. 620, 42 U.S.C. § 301 et seq., including rules and regulations issued under or pursuant thereto, as such act and rules and regulations have been and may from time to time be amended.
SOCIAL SECURITY PROGRAM
The program established under the Social Security Act and extended under and by the enabling act to certain employees and officers of the Commonwealth of Pennsylvania and its political subdivisions and instrumentalities, as such program now exists and may be hereafter modified from time to time.
STATE AGENCY
The Secretary of the Department of Labor and Industry of the Commonwealth of Pennsylvania, or such other person or entity as may be created or designated as the "state agency" under the enabling act.
TOWNSHIP
The Township of Upper Pottsgrove, Montgomery County, Pennsylvania.
The Township hereby elects to become a participant in the social security program, and the benefits of social security shall be extended to employees and officers of the Township with the exception of employees and/or officers performing certain services as may be provided from time to time in the plan and agreement.
The proper officers of the Township are hereby authorized to execute and deliver to the state agency the plan and agreement, including any amendments or modifications thereto or any substitution therefor which the Board of Commissioners may from time to time deem appropriate and approve.
The Treasurer of the Township is hereby authorized to make all required payments into the appropriate fund or funds established by the enabling act and federal regulations, and to establish such system of payroll deductions from wages of Township employees and officers as may be necessary to their coverage under the social security program.
The Board of Commissioners shall appropriate from the proper funds of the Township the amounts necessary to pay into the appropriate fund or funds as provided in the enabling act and federal regulations and in accordance with the plan and agreement.
The proper officers of the Township shall do all things necessary to the continued implementation of the social security program in accordance with the provisions of the plan and agreement, enabling act, Social Security Act and federal regulations.
The participation in the social security program by the Township shall commence as of July 1, 1998.
