In expansion of the declaration of legislative intent and statement of community development objectives found in Article I, § 350-4, of this chapter, and community development objectives contained in Article I, § 350-5, of this chapter, it is hereby declared to be the intent of this article to:
A.
Direct lower-density residential development to areas
of the Township that are more rural in character and less likely to
be served by the extension of centralized sewer and water system networks.
B.
Provide minimum lot dimensions which are compatible
with the need to provide on-site water supply and sewage disposal.
C.
Provide standards and criteria for R-80 development
in appropriate areas of the Township.
D.
Implement the goals of the Upper Pottsgrove Township
Comprehensive Plan and Parks, Recreation and Open Space Plan.
In an R-80 Residential District, a building
or structure may be erected, altered, or used and a lot or premises
may be used or occupied for the following reasons:
A.
A single-family detached dwelling, as outlined below:
(1)
Dimensional standards:
(a)
Lot area per dwelling unit: 80,000 square feet.
(b)
Lot width at the building line, per dwelling
unit: 225 feet.
(c)
Front yard: 50 feet from the ultimate right-of-way.
(d)
Rear yard: 60 feet.
(e)
Side yards: 40 feet minimum; 100 feet aggregate.
(f)
Setback from each street that the lot abuts:
50 feet.
(2)
Minimum setbacks for buildings and structures (except
private garages) that are accessory to a residential use:
(a)
Buildings and structures up to 15 feet in height:
10 feet from side and rear property lines; not permitted in the front
yard setback.
(b)
Building and structures over 15 feet in height:
10 feet from side and rear property lines plus two additional feet
for each one foot, or part thereof, in excess of 15 feet. Maximum
required setback 25 feet; not permitted in the front yard setback.
C.
Open land uses, primarily passive in nature, including
wildlife sanctuary, forest preserve, nature center and similar uses.
D.
Game farm, fish hatchery, hunting or fishing preserve
or similar uses designed for the protection or propagation of wildlife.
E.
Parks and recreation areas for nonintensive uses,
including golf courses (excluding driving range or miniature golf),
hiking, bicycling or bridle trails, picnic areas, playing fields and
similar uses.
F.
Accessory uses on the same lot with and customarily
incidental to any permitted residential use, in compliance with this
chapter.
G.
No-impact home-based business shall be permitted by
right, except that such permission shall not supersede any deed restrictions,
covenant, or agreement restricting the use of land nor any master
deed, by law or other documents applicable to a common interest ownership
community.
