Council shall appoint the Township Attorney pursuant to N.J.S.A. 40A:9-139. Prior to appointment, he/she shall have been admitted to the practice of law in New Jersey.
The Attorney shall be legal counsel to the Council, the Manager and all other departments and agencies except those for which alternate counsel is required by law. He/she shall:
A. 
Handle all legal actions and proceedings by the Township, including appeals, and defend the Township and its employees against adverse litigation, provided that cases in which the Police Department is complainant may be handled by a separate prosecutor.
B. 
Approve all ordinances as to form and defensibility, before their introduction, and all contracts, deeds and other instruments that may be binding on the Township, before their approval and execution, and give written opinions on questions of law.
C. 
Attend Council and other meetings on behalf of the Township, at the request of the Council or the Manager.
D. 
Perform such other services as the Council or Manager may direct.
Whenever the Attorney deems the interests of the Township to so require, he may, with the approval of the Manager and Council and within the limits of available appropriations, appoint special counsel to assist him in the preparation, trial or argument of such legal matters or proceedings as he may determine. Should the Attorney be disqualified with respect to any matter, the Manager, with the approval of the Council, shall appoint special counsel to represent the Township therein.
All papers, documents, memoranda, reports and other materials prepared on behalf of the Township shall be and remain the property of the Township. If filed for convenience at the office of the Attorney, they shall be furnished or returned on request. Upon termination of services, they shall be delivered in accordance with § 3-59 hereof, together with a written consent to substitution of a successor in all legal actions and proceedings then pending to which the Township is a party.
