[HISTORY: Adopted by the Township Committee
(now Township Council) of the Township of Byram 10-2-1974 as Sec. 6-5 of the Revised
General Ordinances of 1974. Amendments noted where applicable.]
A.
No person, while engaged in hunting, target shooting,
practice shooting or other similar activities within the limits of
the Township, shall at any time fire or discharge or cause to be fired
or discharged any pistol, shotgun, rifle or other firearm within 300
feet of a dwelling house, barn or other building or any public or
private street or highway used by the public generally; provided,
however, that nothing in this section shall prohibit the use of firearms
for the protection of life or property where permitted by law; provided,
further, that nothing in this section shall prohibit the discharge
of firearms by any person on property occupied by them as an owner
or tenant, provided that firearms are not discharged upon or across
any public or private street or highway used by the public generally
or within 300 feet of any building owned by any other person.
B.
The provisions of this section shall not apply to
any pistol or rifle range located on a tract of 30 acres or more or
any range which has been duly licensed.

B.
Within the bird sanctuary, no person shall trap, shoot,
hunt or otherwise molest with intent to kill any wild bird nor take
or molest the nest or eggs of any wild bird.
C.
A person convicted in the Municipal Court of violation
of the provisions of this chapter shall be subject to a fine of not
more than $1,250, up to 90 days in prison, or both, which sentence
may include community service in the discretion of the Judge.
D.
The governing body may authorize, eliminate or cause
to be eliminated any nuisance or menace to the health of the community
or to private property from excessive numbers of house sparrows, starlings,
feral pigeons, Canada geese, or other birds.
