From and after the final passage, approval and publication as required by law of this chapter, the number of outstanding licenses at any time to sell alcoholic beverages in this municipality, at retail, shall be limited as follows:
A. 
Not more than three plenary retail consumption licenses.
B. 
Not more than two plenary retail distribution licenses.
C. 
Not more than two club licenses.
A. 
No alcoholic beverage shall be sold, served or delivered by the licensed establishment between the hours of 2:00 a.m. and 7:00 a.m. of any day, except on the first day of January of each year, when sales may be extended throughout the day. The hours fixed herein shall be according to Eastern standard time or Eastern daylight saving time when in effect.
B. 
No delivering or serving of any alcoholic beverages shall be made, permitted or suffered on any licensed premises during any period when the sale of alcoholic beverages is prohibited hereby.
C. 
The selling, serving or delivering of any alcoholic beverage may be made at any time not hereinbefore specifically prohibited.
Each and every license for the sale of any alcoholic beverage shall be issued subject to statutory provisions, the rules and regulations of the State Commissioner of Alcoholic Beverage Control and also any and all rules and regulations to be adopted by the governing body of the municipality.

The annual license fee for each license shall be as follows:
A. 
Plenary retail consumption license: $2,500.
B. 
Plenary retail distribution license: $2,500.
C. 
Club license: $150.
D. 
Person-to-person transfer: $250.
E. 
Place-to-place transfer: $250.
F. 
Person-to-person and place-to-place transfer: $500.
Upon conviction, after a hearing, of any violation of any provision of this chapter or any statute, rule or regulation aforesaid, any license issued or created by this municipality may be suspended or revoked in accordance with rules and regulations heretofore or hereafter promulgated by the Commissioner of Alcoholic Beverage Control.
From and after the effective date of this chapter, no plenary retail consumption license, except for the renewal of an existing license or the transfer of an existing license from person to person within the same premises, shall be granted or transferred to other premises within the proximity of 1,500 feet from any other premises already licensed for a plenary retail consumption license. The distance between licenses shall be measured in a direct line between the closest property lines of each of the premises involved.
