A.
A Length of Service Awards Program (LOSAP) is herewith
created in accordance with P.L. 1997, c. 388, to reward members of
the Fire Company and First Aid Squad of the Borough of Lavallette
for their loyal, diligent, and devoted services to the residents of
the Borough of Lavallette.
B.
The LOSAP shall provide for fixed annual contributions
to a deferred income account for each volunteer member that meets
the criteria set forth herein. Such contributions shall be made in
accordance with a plan that shall be established by the Borough of
Lavallette pursuant to P.L. 1997, c. 388, and said plan shall be administered
in accordance with the laws of the State of New Jersey, the United
States Internal Revenue Code, and this chapter.
The LOSAP shall provide for fixed annual contributions
to each eligible member that meets the criteria as follows:
A.
Any active volunteer member shall be eligible to participate
in the plan immediately upon commencement of active emergency services.
B.
Termination of service. Any participant who terminates
service as an active volunteer member shall cease to participate hereunder.
A former participant will become a participant immediately upon returning
to the service of the plan administrator as an active volunteer member.
The estimated total cost of the program has
been calculated at $45,000 for the year 2003, based upon estimated
maximum Volunteer Fire Company and First Aid Squad membership. The
estimated total annual program cost will vary from year to year based
upon estimated maximum Volunteer Fire Company and First Aid Squad
membership for the year in question.
Each active volunteer member shall be credited
with points for volunteer services provided to the Fire Company and
First Aid Squad of the Borough of Lavallette in accordance with the
point schedule set forth as follows:
A.
Fire Department. A year of active emergency service
shall be credited under the plan for each plan year in which an active
volunteer fire fighter of the Lavallette Volunteer Fire Company accumulates
at least 40 points. A year of active service will commence January
1 and end December 31 of each year. Points shall be granted in accordance
with the following system. Such system shall provide that points shall
be granted for the following activities and upon the approval of the
governing body:

Drills: 15 points maximum; one point per drill. Each
drill shall be a minimum of two hours. Any person who does not have
at least six points acquired for drills will be deemed to have not
met the minimum requirements, regardless of his or her point total.
(3)
Elected or appointed position: 15 points maximum.
(a)
Positions which shall qualify for points under
this section are line officers, Fire Department officers and President,
Vice President, Treasurer, Secretary, and Recording Secretary.
(b)
Upon completion of a one-year term in an elected
or appointed position the appropriate point value shall be applied.
(c)
An active volunteer firefighter elected to serve
as a delegate to a fire-fighters’ convention shall be eligible
to receive one point per meeting.
(4)
Attendance at meetings: 15 points maximum. Attendance
at any official meetings of the Department: one point per meeting.
Meetings shall include any meeting in which the member represents
the firehouse. Any person who does not have at least six points acquired
for meetings will be deemed to have not met the minimum requirements,
regardless of his or her point total.
(5)
Participation in Department responses: 25 points maximum.
Points for responding to a minimum number of calls is outlined below:

(a)
Any person who does not have at least 10 points
acquired for alarms will be deemed to have not met the minimum requirements,
regardless of his or her point total.
(6)
Miscellaneous activities: maximum 20 points. Participation
in inspections and other activities covered by the New Jersey Volunteer
Length of Service Award Law and not otherwise listed: one point per
activity as approved by the governing body. Each activity must be
a minimum of two hours.
(8)
Credit for prior years of service. A member of the
Fire Department shall be credited with a year of service for each
year he or she was a member of the Lavallette Fire Department in good
standing based on the current bylaws. A credit for a year of service
can be earned for each year starting January 1, 1992, through December
31, 2001, provided 40 points have been completed based on the member’s
performance in that year if the program had been in place at that
time.
B.
First Aid Squad. A year of active emergency service
shall be credited under the plan for each plan year in which an active
volunteer member of the Lavallette Volunteer First Aid Squad accumulates
at least 60 points. A year of active service will commence January
1 and end December 31 of each year. Points shall be granted in accordance
with the following system. Such system shall provide that points shall
be granted for the following activities and upon the approval of the
governing body:

Drills: 20 points maximum; one point per drill. Each
drill shall be a minimum of two hours.
(3)
Officer of the First Aid Squad: 10 points maximum.
(a)
Officers of the First Aid Squad are Captain,
Lieutenant, Second Lieutenant and Engineer, Second Engineer, President,
Vice President, Treasurer, Secretary, and Recording Secretary.
(b)
Upon completion of a one-year term as an officer,
the appropriate point value shall be applied.
(c)
An active member of the First Aid Squad elected
to serve as a delegate to a convention shall be eligible to receive
one point per meeting.
(4)
Attendance at meetings: 20 points maximum; attendance
at any official meetings of the organization: one point per meeting.
Meetings shall include any meeting in which the member represents
the organization.
(5)
Participation in Department responses: 60 points maximum.

Duty crew: 30 points maximum.
(a)
One point per duty crew service. Duty crew consists
of a twelve-hour day or night shift. Shifts shall be from 6:00 a.m.
through 6:00 p.m. and 6:00 p.m. through 6:00 a.m. Assignment to duty
crew must be scheduled one week in advance of shift.
(7)
Miscellaneous activities: maximum 25 points. Participation
in inspections and other activities covered by the New Jersey Volunteer
Length of Service Award Law and not otherwise listed: one point per
activity as approved by the governing body. Each activity must be
a minimum of two hours.
(9)
Credit for years of service - A member of the First
Aid Squad shall be credited with a year of service for each year he
or she was a member of the Lavallette First Aid Squad in good standing
based on the current bylaws. A year of service credit can be earned
for each year starting January 1, 1992, through December 31, 2002,
provided 60 points would have been earned in that year based on the
member’s performance had the LOSAP been in place at that time.
The minimum contribution for each active volunteer
member shall be $100 per year of active emergency service, and the
maximum contribution for each active volunteer member shall be $1,150
per year of active emergency service, subject to periodic increases
permitted pursuant to N.J.S.A. 40A:14-185.
A copy of this chapter, once approved by the
voters pursuant to the public question required by P.L. 1997, c. 388,
shall be filed with the Division of Local Government Services within
30 days of the date of the referendum.
All provisions of the Emergency Services Volunteer
Length of Service Award Program Act, P.L. 1997, c. 388, and regulations
promulgated herewith, N.J.A.C. 5:30-14.1 et seq, as well as any revisions,
amendments or additions to the Act or the regulations are hereby incorporated
by reference and made a part of this chapter.
