As used in this chapter, the following terms shall have the meanings indicated:
PART-TIME EMPLOYEE
Any employee who works an average of less than 35 hours per week.
A. 
Office established. There is hereby established the office of Borough Administrator, pursuant to N.J.S.A. 40A:9-136, to administer the business affairs of the Borough of Lavallette and to have such powers and perform such duties as hereinafter set forth, with the exception of those required by law to be exercised by the Mayor and/or Borough Council or by another officer, board or body.
B. 
Appointment; term of office; qualifications. The Borough Administrator shall be appointed by the Mayor with the advice and consent of the Borough Council. The term of office shall be at the pleasure of the governing body, subject to the provisions of state law.
C. 
Powers and duties.
(1) 
The Borough Administrator shall perform the executive responsibility of the municipality and shall supervise all heads of departments and direct the implementation of all policies, ordinances, rules and regulations as adopted by the Borough Council.
(2) 
He/she shall recommend, implement and enforce the procedures and policies of the Borough Council for the coordination, compilation, editing and prompt dissemination and release of public information.
(3) 
He/she shall recommend to the Borough Council adoption of such measures as he/she may deem necessary or expedient for the health, safety and welfare of the community or for the improvement of services of the Borough and shall recommend the nature and location of public improvements authorized by the Borough Council.
(4) 
He/she shall prescribe and enforce rules and regulations for the efficient management of Borough government, subject to approval by the Borough Council and ordinances of the Borough.
(5) 
As a representative of the Borough Council, the Borough Administrator shall investigate all complaints in relation to matters concerning the administration of the government of the Borough and in regard to services maintained by the public utilities in the Borough and shall see that all franchises, permits and privileges granted by the Borough are faithfully observed. He/she shall receive and reply to all inquiries and complaints concerning Borough business, provide information and assistance and remedy, or cause to be remedied, the source of any just complaint.
(6) 
The Borough Administrator shall negotiate contracts for the Borough as authorized by and subject to the approval of the Borough Council. He/she shall ensure that all terms and conditions favorable to the Borough in any statute or contract are faithfully kept and performed and, upon knowledge of any violation, shall call the same to the attention of the Borough Council.
(7) 
The Borough Administrator shall prepare and submit to the Borough Council, as of the end of the year, a complete report on the finances and administrative activities of the Borough for the preceding year.
(8) 
The Borough Administrator shall perform such other duties as may be required by the Borough Council, consistent with the laws of the State of New Jersey or the Borough.
(9) 
The Borough Administrator shall, before separation from the Borough, render a report on all activities of the Borough from the date of his/her last report to the date of his/her separation.
D. 
Qualifications To be appointed to the position of Borough Administrator, an individual should meet the following requirements:
(1) 
Graduation from an accredited college or university with a bachelor's degree, preferably in business administration. This requirement can be waived by the governing body by resolution adopted at a public meeting after affording the public the right to comment on the proposed resolution.
(2) 
Possess ability to read, write, speak, understand and communicate in English sufficiently to perform the duties of this position.
(3) 
Persons with mental or physical disabilities are eligible as long as they can perform the essential functions of the job after reasonable accommodation is made to their known limitation. If the accommodation cannot be made because it would cause the employer undue hardship, such person may not be eligible.
(4) 
Five years' experience in business administration is preferred but not required.
E. 
Removal from office. The Borough Administrator may be removed by a 2/3 vote of the Borough Council. The resolution of removal shall become effective three months after its adoption by the Borough Council. The Borough Council may provide that the resolution shall have immediate effect; provided, however, that the Borough Council shall cause to be paid to the Administrator forthwith any unpaid balance of his/her compensation and his/her compensation for the next three calendar months following adoption of the resolution.
F. 
Compensation. The Borough Administrator shall receive such compensation as shall be prescribed from time to time by the salary ordinances of the Borough of Lavallette.[1] This is an exempt nonclassified position.

A. 
Office established; term of office. There is hereby established the position of Borough Attorney pursuant to N.J.S.A. 40A:9-139. The Borough Attorney shall be appointed by the Mayor with the advice and consent of the Borough Council and shall serve a one-year term of office.
B. 
Qualifications. To be appointed to the position of Borough Attorney an individual must be an attorney authorized to practice law in New Jersey.
A. 
Office established. There is hereby established the office of the Municipal Clerk for the Borough of Lavallette pursuant to N.J.S.A. 40A:9-133.
B. 
Appointment; term of office. The Municipal Clerk shall be appointed by the Mayor, with the advice and consent of the Borough Council, and shall serve for a term of three years as provided by N.J.S.A. 40A:9-133.
C. 
Duties and qualifications.
(1) 
The Municipal Clerk shall serve as the Clerk of the Council, perform such functions as may be required by N.J.S.A. 40A:9-133 and other laws, and shall maintain the records and minutes of the Council.
(2) 
To be appointed by the office of Municipal Clerk, an individual must possess a Municipal Clerk certificate pursuant to the requirements of N.J.S.A. 40A:9-133.2
A. 
Office established. There is hereby established the position of Deputy Municipal Clerk for the Borough of Lavallette pursuant to N.J.S.A. 40A:9-135.
B. 
Appointment; term of office. The Deputy Municipal Clerk shall be appointed by the Mayor, with the advice and consent of the Borough Council, and shall serve for a term of three years, commencing on January 1 of the year of appointment and ending on December 31 of the third year, or until a successor shall be appointed and qualified. A vacancy in the office of Deputy Municipal Clerk, other than due to expiration of term, shall be filled by appointment for the unexpired term.
C. 
Duties. The Deputy Municipal Clerk shall have all the powers and perform all the duties of the Municipal Clerk during such times and for such specific periods when the Municipal Clerk is absent, disabled or otherwise unable to perform those duties. The Deputy Municipal Clerk shall assist the Municipal Clerk in the performance of the duties of the Municipal Clerk's office.
A. 
Office established. There is hereby established the position of Borough Engineer pursuant to N.J.S.A. 40A:9-140.
B. 
Term of office. The Borough Engineer shall be appointed by the Mayor with the advice and consent of the Borough Council and shall serve a one-year term of office.
A. 
Office established. There is hereby established the office of Chief Financial Officer for the Borough of Lavallette pursuant to N.J.S.A. 40A:9-140.10.
B. 
Appointment; term of office. The Chief Financial Officer shall be appointed by the Mayor, with the advice and consent of the Borough Council. The Chief Financial Officer shall serve a term of office of four years, commencing on January 1 of the year of appointment and ending on December 31 of the fourth year, or until a successor shall be appointed and qualified.
C. 
Qualifications. To be appointed to the office of Chief Financial Officer, an individual must meet the qualifications established under N.J.S.A. 40A:9-140.1 et seq., as amended.
D. 
Duties. The Chief Financial Officer shall be responsible for managing the finances and financial records of the municipality. The Chief Financial Officer shall:
(1) 
Perform all of the duties required by state statute and set forth in the rules, regulations and guidelines established by the Division of Local Government Finances for the State of New Jersey.
(2) 
Assist in the preparation of the annual budget and ensure that the municipality complies with all requirements of the Division of Local Government Services concerning municipal finances.

There is hereby established the office of Purchasing Agent for the Borough of Lavallette.
B. 
Appointment and term of office. The Purchasing Agent shall be appointed by the Mayor, with the advice and consent of the governing body, and shall serve a term of office of three years, commencing on January 1 of the year of appointment and ending on December 31 of the third year, or until a successor shall be appointed and qualified.
C. 
Qualifications. To be appointed to the position of Purchasing Agent, a person must have five years of experience in the writing of purchase specifications and in the purchase of equipment, materials, and supplies on a large scale and have graduated from an accredited college or university with a Bachelor's degree or have additional experience as indicated on a year-for-year basis with 30 semester hour credits being equal to one year of experience. The Purchasing Agent must also have completed the purchasing and administration courses offered by Rutgers University or the equivalent in experience and demonstrated training and knowledge.
D. 
Duties. The Purchasing Agent shall act as contracting agent for the Borough of Lavallette and shall have the authority to prepare public advertising for bids; to receive bids for the purchase of work, materials and supplies on behalf of the Borough; and to negotiate and award contracts which are not required to be submitted for public bidding pursuant to the Local Public Contracts Law. In addition, the Purchasing Agent shall perform such other related duties as prescribed within the job specifications as promulgated by the New Jersey Department of Personnel and as otherwise prescribed by the Mayor and Borough Council.

Office established. There is hereby established the office of Tax Collector of the Borough of Lavallette pursuant to N.J.S.A. 40A:9-141.
B. 
Appointment; term of office. The Tax Collector shall be appointed by the Mayor, with the advice and consent of the Borough Council, and shall serve for a term of four years, commencing on January 1 of the year of appointment and ending on December 31 of the fourth year, or until a successor shall be appointed and qualified. A vacancy in the office of Tax Collector, other than due to expiration of term, shall be filled by appointment for the unexpired term.
C. 
Qualifications. To be appointed to the position of Tax Collector for the Borough of Lavallette, an individual must be certified as required pursuant to N.J.S.A. 40A:9-141 et seq.
D. 
Duties. The duties of the Tax Collector shall be as prescribed by law. The Tax Collector shall perform such other related duties as are prescribed by Mayor and Borough Council.
A. 
Office established. There is hereby established the office of Tax Assessor for the Borough of Lavallette pursuant to N.J.S.A. 40A:9-146.
B. 
Appointment; term of office. The Tax Assessor shall be appointed by the Mayor with the advice and consent of the Borough Council to a term of four years from the first day of July next following his/her appointment. Vacancies other than due to expiration of term shall be filled by appointment for the unexpired term.
C. 
Qualifications. The Tax Assessor shall hold a Tax Assessor certificate as provided for by N.J.S.A. 40A:9-148.1.
D. 
Duties. The Tax Assessor shall have the duty of assessing property for the purpose of general taxation.
A. 
Office established. There is hereby established the office of Certified Animal Control Officer.
B. 
Appointment. A Certified Animal Control Officer shall be appointed by the Mayor, with the advice and consent of the Borough Council, and shall serve a term of one year, commencing on January 1 of the year of appointment and ending on December 31 of that year, or until a successor or successors shall be appointed and qualified.
C. 
Qualifications. The Certified Animal Control Officer shall be a person 18 years of age or older who has satisfactorily completed the course of study approved by the Commissioner of Health and Senior Services and the Police Training Commission as prescribed by N.J.S.A. 4:19-15.16(a); or who has been employed in the State of New Jersey in the capacity of, and with similar responsibilities to those required of, a certified animal control officer pursuant to the provisions of N.J.S.A. 4:19-15.16(a) for a period of three years before January 17, 1987.
D. 
Duties. The duties of the Certified Animal Control Officer shall be the enforcement of Chapter 66, Animals, and any other duties as may otherwise be prescribed by law. The Certified Animal Control Officer shall perform such other related duties as are prescribed by Mayor and Borough Council.
A. 
Office established. There is hereby established the office of Emergency Management Coordinator.
B. 
Appointment; qualifications; duties. The Emergency Management Coordinator shall be appointed pursuant to the requirements of N.J.S.A. App. A:9-40 et seq. The qualifications and duties of the Emergency Management Coordinator shall be in accordance with N.J.S.A. App. A:9-40 et seq.
A. 
Office established. There is hereby established the office of Administrative Clerk for the Borough of Lavallette.
B. 
Appointment; term of office. The Administrative Clerk shall be appointed by the Mayor, with the advice and consent of the Borough Council, and shall serve a term of one year, commencing on January 1 of the year of appointment and ending on December 31 of that year, or until a successor or successors shall be appointed and qualified.
C. 
Qualifications. To be appointed as Administrative Clerk for the Borough of Lavallette, an individual must possess five years of experience in clerical work.
D. 
Duties. The duties of the Administrative Clerk shall be to assist the Administrator in the day-to-day operations of the Borough of Lavallette by doing administrative clerical and related work.
