A. 
Each residential and nonresidential unit shall be billed a minimum quarterly charge of $69 per unit for use of 5,000 gallons of water or less per quarter.
B. 
Excess usage charge. The charge for usage in excess of the minimum quarterly allowance of 5,000 gallons of water shall be $4.25 per 1,000 gallons or part thereof. The excess usage shall be billed in the quarter following the actual usage.

An annual capital/infiltration charge of $300 shall be billed for each existing sewer lateral servicing or available to service a residential unit, nonresidential unit or vacant parcel of land which complies with the minimum dimensions as established in Chapter 90, Zoning, for a lot in the zone in which it is located. This charge shall be made regardless of whether the residential unit, nonresidential unit or vacant parcel of land is actually connected to a sewer lateral. The capital infiltration charge shall be billed in advance on a quarter-annual basis.
In the event that a residential or nonresidential user shall fail to install a water meter, the Superintendent of Public Works shall estimate the water usage for every 1,000 gallons of water or part thereof consumed by any user, and the user shall be billed a sewer usage charge based upon such estimated water usage, in addition to the capital infiltration and minimum quarterly charges established in this chapter.
A. 
Bills for the capital infiltration charge and minimum quarterly charge shall be issued in advance on a quarter-annual basis. Bills for excess sewage usage charges shall be issued on a quarter-annual basis in the quarter following the actual usage. All sewer usage charges shall be due and payable within 30 days of the billing date.
B. 
In the event that any charges are not paid within 30 days of the billing date, then said charges will be delinquent, and services to the customer having a delinquent account may be discontinued by the Borough pursuant to § 52-10. Interest shall be charged pursuant to the guidelines set out in § 52-31.
C. 
Charges shall draw interest from the time they become due in accordance with N.J.S.A. 40:14A-21 (presently 18% per annum), and shall be a lien upon the premises until paid.
Each user discharging prohibited wastes or substances described in § 52-5 that cause an increase in treatment costs or costs associated with the managing of the effluent or sludge of the Ocean County Utilities Authority shall pay such increased costs in accordance with guidelines for approved user charge system adopted by the Ocean County Utilities Authority. The Borough of Lavallette will assist the Ocean Counties Utilities Authority in taking whatever steps necessary to enforce payment of such costs by the user.
The annual rates shall be reviewed not less often than every two years. The annual rates shall be revised, if necessary, at such times to accomplish the following:
A. 
Maintain the proportionate distribution of operation and maintenance costs among users.
B. 
Generate sufficient revenue to pay their total operation and maintenance costs.
The Borough of Lavallette will notify its users at any time the Borough changes its rates or the Ocean County Utilities Authority changes its rates. The notice will include a breakdown of costs which shows the rate and that approximate portion of its changes which are attributable to the Ocean County Utilities Authority's wastewater treatment services.
The Borough of Lavallette's system of billing will permit all users to be evenly charged for all flow not directly attributable to users in the same manner that the Borough distributes the cost of operation and maintenance of the user's wastewater flow.
Newly constructed properties connecting to the sewage treatment and disposal system shall be liable for a pro rata charge for the year in which the connection is made, beginning with the first day of the month following the date of connection.
