If, before favorable referral and final approval by the Planning Board has been obtained, any person, firm or corporation transfers, sells or agrees to sell, except pursuant to an agreement expressly conditioned on final subdivision approval, as owner or agent, any land which forms a part of a subdivision on which, by ordinance, the Planning Board is required to act, such person, firm or corporation shall be subject to a fine of no less than $100 and no more than $1,000, imprisonment not to exceed 90 days or community service of not more than 90 days, or any combination of fine, imprisonment and community service, at the discretion of the court having jurisdiction in this matter. Each parcel, plot or lot so disposed of shall be deemed a separate offense and each day that such violation exists shall constitute a separate offense.
