The first Monday in September of each year and the Saturday and Sunday immediately preceding that Monday (together commonly known as "Labor Day weekend") have traditionally been the occasion of parades and other special community events in the Borough of Mendham, usually including certain legalized games of chance conducted by nonprofit organizations of the borough in accordance with law. The statutes of the State of New Jersey, and regulations promulgated thereunder, provide that no such games of chance may be conducted on a Sunday except as specifically authorized by an ordinance of the municipality in which they are to occur. It is the intent and purpose of this chapter to provide for holding certain of those games of chance on the one Sunday only in each year which forms part of the Labor Day weekend, by those nonprofit organizations having a year-round association with the Borough of Mendham, in conjunction with and as part of the traditional Labor Day weekend celebration.
The following legalized games of chance, as each is defined in the section of the New Jersey statutes opposite its designation, shall be permitted in the borough on one Sunday only in each year, that being the Sunday immediately preceding the first Monday in September (Labor Day), all in accordance with the further provisions of this chapter:
A. 
Raffles: N.J.S.A. 5:8-51.
B. 
Amusement games: N.J.S.A. 5:8-101.
The holding or operation of games authorized by § 115-2 hereof shall, on the Sunday permitted thereby, be limited to the hours between 2:00 p.m. and 9:00 p.m.
No person, organization or other entity shall operate or conduct any game of chance as herein provided for except upon issuance of a license by the Borough Clerk, which license shall specifically state the date and hours permitted hereunder. No license shall be issued granting permission pursuant to this chapter except to bona fide nonprofit organizations which function in the Borough of Mendham on a year-round basis and which otherwise qualify under the laws and regulations of the State of New Jersey pertaining to legalized games of chance.
Nothing contained in this Chapter 115 shall be construed to impose any limitation on the conduct of legalized games of chance on any day except Sunday, which conduct shall continue to be governed by the statutes and regulations of the State of New Jersey.

Any person violating any of the provisions of this chapter shall be subject, upon conviction, to the penalties provided in § 1-15 of this Code.
