The municipal tennis courts of the Borough of Mendham shall be under the jurisdiction of the Recreation Committee of the Borough Council.[1]

No person or persons shall play or enter upon the municipal tennis courts unless and until such person has received, under this article, a regularly numbered tennis privilege badge and unless such badge is worn by such person in plain sight on the outside of his or her clothing.
Such badge shall be procured from the Borough Clerk, or such other officer or employee of the borough authorized to act, by paying the fee hereinafter prescribed. A new badge shall be procured for each season, which shall commence April 1 of each year and end March 31 of the following year.
Guests may secure a special badge to play or enter upon the municipal courts, which shall be good for one hour of playing time. Said special badge shall be issued in the same manner and under the same terms and conditions as regular badges, as set forth in this article. The fee as set forth in Chapter 102, Fees, shall be charged for said special badge. A guest must be sponsored by a holder of a badge, as set forth in § 143-6, which is in good standing, and the guests must be accompanied and escorted at the courts by the holder thereof. No one who is a resident of the borough shall be eligible for guest status under this section.
A. 
The fees as set forth in Chapter 102, Fees, shall be charged for the use of the borough tennis courts.
B. 
The fee schedule contained in Chapter 102, Fees, may be adjusted from time to time by resolution of the Borough Council, upon the recommendation of the Recreation Committee.
Such badge so issued shall not be transferable and must not be used or worn by any other person other than the person to whom issued. Any person to whom such badge is so issued who permits another person to use his or her badge for the purpose of playing or entering on said courts may have his or her badge and privilege withdrawn, and in such case shall not again play or enter upon said courts for a period of one month. The wearing of any such badge by any person playing or entering on said courts other than the person to whom the badge was issued shall be evidence under this article of its transfer.
The Recreation Committee is hereby authorized to formulate rules of conduct for the users of said courts and others who may be upon the grounds immediately surrounding said courts, said rules to be approved by the governing body. The rules shall not be in force and effect until they are conspicuously posted at the courts. No person who shall act in a loud, boisterous, lewd or indecent manner or who shall curse or swear or who shall be in an intoxicated condition shall be allowed on said courts or on the grounds surrounding the same. Any such person shall be excluded therefrom by any member of the Recreation Committee or other authorized officer or employee of the borough. Gross or repetitious violations of the rules of conduct by a person shall be grounds for permanent revocation of his or her tennis privileges by the Recreation Committee.
The Recreation Committee is hereby authorized to schedule the hours during which the tennis courts shall be available and may, from time to time, reserve the use of the courts for specific periods to the West Morris Mendham High School or the Mendham Borough Elementary School Tennis Programs, at no charge.

Any person or persons who shall violate any of the provisions of this article shall be subject, upon conviction, to the penalties provided in § 1-15 of this Code, in the discretion of the Judge imposing the same.
