A code regulating the sanitary and safety conditions
for recreational bathing places and to preserve and improve the public
health and providing for the inspection of such recreational bathing
places and the fixing of fees is hereby established pursuant to Chapter
IX of New Jersey State Sanitary Code.[1] A copy of the code is made a part hereof without the inclusion
of the text herein.

The code established and adopted by this chapter
is described and commonly known as "Chapter IX of the New Jersey State
Sanitary Code," which was adopted in January 1987, as amended and
supplemented.
Three copies of Chapter IX of the New Jersey
State Sanitary Code, adopted in January 1987, have been placed on
file in the office of the Secretary of the Board of Health for the
use and examination by the public.
A.
No person shall, within the Borough of Mendham, operate
or allow to be operated a recreational bathing place or facility,
as defined in Chapter IX of the New Jersey State Sanitary Code, without
first having obtained a license or licenses from the Board of Health
in such form or forms as the Board may from time to time issue.

The penalty for any violation of this chapter
shall be not less than $50 nor more than $500. Each day a violation
continues shall constitute a separate violation.
