A Police Department is hereby established in
the Township of Middle, County of Cape May. The Department shall consist
of not more than the following:

The Township Committee shall determine all policy
with regard to the Police Department. The member of the Township Committee
to whom the Department is assigned shall be known as the "Director
of Public Safety" and shall have supervision of the Police Department
through the Chief of Police, according to law. He shall recommend
to the Township Committee such measures as he shall deem necessary
or expedient for the welfare of the township and the organization
and development of the Police Department. The day-to-day operation
of the Police Department shall be vested in the Chief of Police pursuant
to N.J.S.A. 40A:14-118.
All members of the Police Department shall be
appointed, compensated and promoted by the Township Committee. Special
officers may be appointed for a term not to exceed one year. All other
appointments to the Police Department shall be for a probationary
period. The Township Committee may, at its sole discretion, appoint
a police officer to a permanent position during good behavior, efficiency
and residence within the township at an annual salary or terminate
his employment.
Before entering upon the duties of his office,
each member of the Department shall take and subscribe to such oath
of office and allegiance as shall be prescribed by law.

The annual salary and wages of the paid members
of the Police Department shall be as established by the Salary Ordinance.[1]

Application for appointment to the Police Department
shall be in writing, and each applicant, to be eligible for appointment,
shall be qualified as provided by law.

A.
Preference shall be given to residents of Middle Township
for appointment to the Township Police Department pursuant to N.J.S.A.
40A:14-123.1(a).
B.
All applicants for appointment to or promotion within
the Police Department shall be qualified for appointment or promotion
as required by law, ordinance and Department of Personnel rules and
regulations. All applicants for appointment shall be residents of
the Township of Middle, and must maintain continuous residency within
the Township of Middle from the announced closing date of the Department
of Personnel examination up to and including the date of appointment.
The Chief of Police and the several patrolmen
shall have all of the powers incident to the office and shall cause
the public peace to be preserved, see that all ordinances of the township
are enforced, cause the enforcement of the motor vehicle laws of the
State of New Jersey and such other laws of the State of New Jersey
as shall come within the scope of their jurisdiction and shall carry
out such other duties as are assigned to them or specifically prescribed
for them by the Revised Statutes of the State of New Jersey and the
local ordinances.[1]

The Police Department shall be governed, controlled
and administered by the Township Committee in accordance with rules
and regulations which shall be adopted by resolution and promulgated.
The Administrative Code of Regulations[1] is hereby made a part of this chapter by reference and
shall carry into effect the intent and purpose of this chapter by
providing for the efficient conduct of the Police Department.
