No person, firm, partnership or corporation shall cause to be held any
public auction within the limits of the Township of Middle without first having
obtained a license for so doing.
Before any license is granted, the applicant therefor shall make application,
in writing and under oath, and file the same with the Township Clerk. The
application shall state:
Licenses shall be obtained by each individual, firm, partnership or
corporation who shall desire to conduct an auction or sell goods of any description
subject to open bids and shall entitle the licensee to conduct auction sales
upon the licensed premises within the confines of the Township of Middle for
a period of one year from the first day of January of each year.
The annual license fee for auction sales shall be computed at the rate
of $250 for each auctioneer employed by the licensee, and the fee shall be
payable in full, regardless of the date upon which the license is issued.

A license shall be obtained by every person, firm or corporation to
conduct an auction sale at a specified location and date only, and a new and
separate license shall be required for each additional day on which the auction
sale is held. Such license shall be good only for the date or alternate rain
date and place for which issued. A license shall be required for any and all
public auction sales of personal property or real property and shall be required
for the sale at auction of privately owned household goods, farm implements,
livestock or real property by the owner or public auctioneer.

The license fees for each auction sale which shall be limited to one
day only shall be as follows:
A.
Ten dollars for each license covering a sale at auction
of household goods, farm implements or livestock owned by the applicant, as
distinguished from those purchased for resale, which are being sold at or
upon the private residence or farm of the applicant either by the owner himself
or by a public auctioneer.
B.
Twenty-five dollars for each license covering the sale
at auction of real estate.
C.
Twenty-five dollars for each license covering the sale
at auction of any and all goods or merchandise.
Any person, firm, partnership or corporation violating any provision
herein contained or failing to declare the full number of auctioneers shall,
upon conviction of such violations before the Municipal Judge, be subject
to one or more of the following: a fine not to exceed $1,000 or imprisonment
for a period of not more than 90 days or a period of community service not
to exceed 90 days for each specific act committed in violation of the provisions
of this chapter.
