A certain document, one copy of which is on file in the office of the Clerk of the Township of Middle, being marked and designated as the "BOCA National Property Maintenance Code, Fourth Edition, 1993," as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Property Maintenance Code of the Township of Middle, County of Cape May, State of New Jersey, for the control of buildings and structures as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Property Maintenance Code are hereby referred to, adopted and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in § 193-18 of this article.

The BOCA National Property Maintenance Code is amended and revised in the following respects:
A. 
In Section PM-101.0, insert "Township of Middle, County of Cape May, State of New Jersey."
B. 
In Section PM-106.2, insert "fine of not less than $50 nor more than $1,000."
C. 
Delete Section PM-304.12 (page 11).
D. 
Delete Section PM-305.3 (page 11).
E. 
Delete Section PM-305.4 (page 11).
F. 
Delete Sections PM-602.2, PM-602.2.1 and PM-602.2.2 (page 17).
G. 
Delete Section PM-602.3 (page 17).
H. 
Delete Section PM-602.4 (page 17).
I. 
In Chapter 8 (page 23), substitute "National Standard Plumbing Code, 1993" for "1993 BOCA National Plumbing Code."
J. 
Delete Section PM-303.8 Motor vehicles (page 10).

A. 
A copy of the 1993 BOCA National Property Maintenance Code marked so as to plainly indicate what portion thereof, if less than the whole, is intended to be adopted, is annexed to this article. One copy of said 1993 BOCA National Property Maintenance Code, similarly marked, has been placed on file in the office of the Township Clerk upon the introduction of this article and will remain on file there, until final action is taken on such article, for use and examination by the public. Upon adoption of this article, the one copy shall remain on file in the office of the Township Clerk so long as this article is in effect. Three copies of the 1993 BOCA National Property Maintenance Code shall also be placed on file and shall remain on file in the office of the Construction Official, the department having charge of the enforcement of said article, for so long as said article shall remain in effect, said code being placed there for use and examination by the public.
B. 
The Construction Official shall designate the Code Enforcement Official, the Township Board of Health, the Superintendent of Public Works, the Zoning Officer and such other township officials as he shall deem necessary as his duly authorized representatives for the enforcement of this article and the code adopted hereby.
The provisions of the 1993 BOCA National Property Maintenance Code shall not be construed to prevent the enforcement of other ordinances or regulations which prescribe standards other than those provided in said Property Maintenance Code. In the event of conflict, the most restrictive provisions shall apply.
