[HISTORY: Adopted by the Township Committee of the Township of Middle 8-7-2006 by Ord. No. 1230-06. Amendments noted where applicable.]
A. 
The Township of Middle is constructing a skateboard park at the Clarence Davies Complex with an address of 626 Goshen Road, Goshen, New Jersey. Located within the Carl Baker Building at the Clarence Davies Complex are offices for the staffing of Recreation Department Administration, and the Township Recreation Program Administrator has a permanent office located within the Carl Baker Building at the Clarence Davies Complex.
B. 
Under the direction of the Middle Township Recreation Program Administrator and the Middle Township Recreation Advisory Commission, various rules and regulations governing the use of the municipal parks have been promulgated.
C. 
The rules and regulations have been promulgated by the Recreation Program Administrator, the Recreation Advisory Commission and the Recreation Commission and have been reviewed by the governing body of the Township of Middle, which been approved via Resolution Nos. 265-06 and 266-06.

The hours of operation for the Middle Township Skate Park shall be set by the governing body of the Township of Middle as deemed necessary. Said hours shall be posted for public inspection accordingly.
A. 
The Township of Middle reserves the right to close the park at any time.
B. 
The Township of Middle reserves the right to expel anyone from the park for a violation of the rules.
C. 
All organized events shall have written permission from the Department of Recreation and appropriate permits.
D. 
No skating or trespassing when the park is closed.
E. 
No skating when the equipment is wet or icy.
F. 
Skating is prohibited on Township of Middle property surrounding the skateboard park.
G. 
The Township of Middle suggests that a parent or guardian accompany children under 12.
H. 
Admittance to the park shall be limited to the established maximum capacities.
I. 
This facility is for skateboard and in-line skating only. The use of bicycles, of any type, is expressly prohibited.

J. 
All users must skate and act responsibly.
K. 
All users are required to wear shoes, helmets, kneepads, wrist pads and elbow pads.
L. 
All equipment must be worn to manufacturer's specifications.
M. 
Additional obstacles or other materials may not be used on this skateboard park facility.
N. 
No glass, radios or pets in or around the skating area.
O. 
Backpacks, bags and jackets must be placed in the appropriate area.
P. 
Use of drugs, alcohol, tobacco, profanity, abusive language and/or vandalism is strictly prohibited and shall result in automatic and permanent expulsion from the facility and all other penalties provided for to the fullest extent of the law.

Any person who violates this chapter shall be subject to a fine which shall amount to no less than the minimum amount of $50 and not to exceed a maximum amount of $100.

A. 
Any and all users of the skateboard park must first register with the Middle Township Recreation Department. The Recreation Department shall issue an identification card with a photo identification for each individual.
B. 
Fees.
(1) 
Middle Township residents shall use the skateboard park without charge.
(2) 
Non-Middle Township residents shall pay an annual fee of $25 per person, or a $5 per-person daily rate, which fees shall be assessed and collected by the Recreation Department.

Violation of this Chapter 211 constitutes a breach of the peace.
