The office of Municipal Tax Collector is hereby created.
The term of office of the Municipal Tax Collector shall be for a term of four years from the first day of January next following his election or appointment. Vacancies other than those due to expiration of term shall be filled by appointment for the unexpired term.
Any person who shall be reappointed to the office of Tax Collector upon the completion of one full term of four years shall thereafter continue to hold such office during good behavior and shall not be removed therefrom except for good cause shown after a fair and impartial hearing; provided, however, that such person files with the Clerk of the Borough of Rockaway and the Division of Local Finance in the Department of Community Affairs a certificate evidencing his satisfactory completion of a course of instruction in the functions and duties of tax collectors, as provided by N.J.S.A. 40A:9-145.
The compensation of the Municipal Tax Collector shall from time to time be fixed by the Mayor and Council by ordinance or, if a salary guide has been adopted by ordinance, then by a resolution regularly adopted. Said compensation may be inclusive of any other salaries or remuneration for any other official duties performed by the same person.
The Municipal Tax Collector shall be responsible for notifying each record owner of property in the Borough of Rockaway of the amount owed the Borough for real property taxes and assessments, collection of all real property taxes and assessments, preparation of all necessary documents required under the In Rem Tax Foreclosure Act (N.J.S.A. 54:5-104.29 et seq.) and all other duties and responsibilities required by statute, regulation, ordinance or directive of the Mayor and Council.
During the absence or disability of the Municipal Tax Collector, the Mayor and Council may, by resolution, determine that an absence exists or that said Collector is suffering a disability and in said resolution appoint an officer of the Borough or any other person deemed qualified to perform the duties of said Collector.
