As used in this chapter, the following terms shall have the meanings indicated:
ALUMINUM
Recyclable aluminum cans.
CONTAINERIZED
The placement of yard waste in a trash can, bucket, bag or other vessel, such as to prevent the yard waste from spilling or blowing out into the street and coming into contact with stormwater.

CORRUGATED CARDBOARD
Includes that type of paper in which a portion has been made to have a wavy surface (alternating ridges and grooves) and is placed between two flat surfaces for the sake of strength and which is commonly used to form cartons.
DESIGNATED MATERIALS
Those recyclable materials listed in the Morris County District Recycling Plan which are mandated to be source separated for recycling, namely: glass (bottles and jars), aluminum beverage cans, newspaper and yard waste, residentially; and edible fats, tallow, waste oil, glass, aluminum cans, corrugated cardboard and office paper, for commercial and institutional establishments. For the purpose of this article, this term shall also mean any additional materials stipulated by the Borough for recycling, such as tin cans, plastic, oil, tires, bulk materials, etc.
GARBAGE
Includes refuse of animals or vegetable foodstuffs, ashes, broken dishes and all refuse incident to the ordinary conduct of a household or business but not manufacturing business or such as may result from building operations or repairs and shall exclude any designated materials.
GLASS
All products made from silica or sand, soda ash and limestone, the product being transparent or translucent and being used for packaging or bottling of various matters, and all other material commonly known as "glass," excluding, however, blue and flat glass commonly known as "window glass."
NONRESIDENTIAL
Includes the owner, lessee or occupant of any building or establishment other than single-family or multiple-family dwellings. "Nonresidential" shall also include any industrial establishment or any establishment organized, founded or dedicated to public service or culture, including but not limited to religious, educational, health-care and governmental establishments.
OFFICE PAPER
Includes high-grade papers generally used in offices that are of high quality and do not have a glossy finish, including but not limited to computer, letterhead, ledger and photocopy paper.
PERSONS
All individuals, partnerships, corporations, owners, tenants, lessees, occupants, associations and organizations residing, owning or operating, managing, leasing or occupying any premises or commercial or industrial business within the Borough of Rockaway and served by municipal solid waste collection service.
RESIDENTIAL
Includes any person who owns, leases and/or occupies dwellings within the municipality, including those in multifamily dwellings and/or single-family developments.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive or other way which is an existing state, county or municipal roadway and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas, and other areas within the street lines.

USED NEWSPAPER
Includes paper of the type commonly referred to as "newsprint" and distributed at stated intervals, normally daily or weekly, having printed thereon news and opinions and containing advertisements and other matters of public interest Expressly excluded, however, are all magazines or other periodicals, glossy-surfaced supplements and inserts, telephone books, catalogs, junk mail and paper products of any other nature.
YARD WASTE
Vegetative matter generated from the process of yard or ground maintenance, including but not limited to grass clippings, weeds, leaves, limbs and brush. Each limb and piece of brush shall not exceed three inches in diameter.
The Council may from time to time make other rules and regulations governing the care, collection, removal and disposal of garbage. A printed copy of such rules and regulations shall be furnished to every household, on demand.

The Mayor and Council of the Borough of Rockaway may make provision, either by contract or through Borough employees, or otherwise as circumstances may require, for the collection and disposal of garbage from residential properties, and is authorized and empowered to determine from time to time the extent and frequency of collections and to make suitable rules and regulations with respect to same.

A. 
The owner, tenant or occupant of any house, dwelling or apartment occupied as a residence or the owner, tenant, licensee or occupant of any commercial or industrial business operated within the Borough of Rockaway shall cause all garbage to be put in watertight receptacles provided with a tight-fitting cover and handle consistent with the rules and regulations governing the care, collection, removal and disposal of garbage.
B. 
Such receptacles and bundles shall be placed at or near the curb in front of such house or premises on such days as shall be designated by the Mayor and Council for the particular locality in which the residence may be for the purpose of being collected and taken away. Such receptacles shall be removed from the public street and taken to the rear of the residence or some other closed areaway following such collection.
No person shall throw, lay, deposit or leave or cause to be thrown, laid, deposited or left in or upon any street, sidewalk, parking, vacant lot or yard or premises surrounding any dwelling house or other building or other public place in the Borough any garbage or any other matter or thing of a like nature.[1]
