As used in this chapter, the following terms shall have the meanings indicated:
MULTIPLE-FAMILY DWELLING
Any building or structure in which three or more families reside.
OUTDOOR GRILL
Charcoal grills, whether installed or portable, including grills utilizing ceramic briquettes and LP or natural gas, hibachi-type grills or any other type of grill, whether portable or stationary, used for barbecuing, grilling, roasting, frying or cooking; outdoor fireplaces; fire rings; fire pits; or chimineas.
It shall be unlawful for any person to use an outdoor grill:
A. 
On any part of any multiple-family dwelling;
B. 
Within 10 feet of any multiple-family dwelling; or
C. 
In any other location or manner deemed to be a fire hazard by the Fire Marshal of the Borough of Rockaway, pursuant to § 153-3.
A. 
In the event that the Fire Marshal of the Borough of Rockaway shall determine, pursuant to § 153-2C, that a fire hazard exists, he shall issue a written warning to the person engaging in the hazardous activity ordering the person to cease the activity. If the name of the person engaged in the hazardous activity is unknown to the Fire Marshal, he may fulfill the requirement of giving written notice by mailing or personally serving the warning on the property owner upon whose property the hazardous activity has occurred.
B. 
It shall be a violation of this chapter for any person who has received a written warning by the Fire Marshal of the Borough of Rockaway to utilize an outdoor grill in any location or manner determined to be hazardous by the Fire Marshal.

A fine of not less than $100 nor more than $2,000 shall be imposed upon any person found to have violated the provisions of this chapter. Each and every violation shall be deemed a separate offense, subject to the penalty stated herein.

The Fire Marshal or Health Officer or Police Department is hereby designated to serve as the chief administrative agent of this chapter. All inspections and enforcement of the provisions of this chapter shall be under his or her direction and supervision. He or she may appoint or designate such other officials or employees of the Borough to perform such duties as may be necessary for the enforcement of this chapter.
