This chapter shall be known and shall be cited
as the "Land Subdivision and Site Plan Review Ordinance of the Borough
of Rockaway."
A.
Pursuant to N.J.S.A. 40:55D-37 approval of subdivision
plats by resolution of the Land Use Board shall be required as a condition
for the filing of such plats with the County Recording Officer. Approval
of site plans by resolution of the Land Use Board shall be required
as a condition for the issuance of a building permit and certificate
of occupancy for any development, except that subdivision or individual
lot applications for detached one- or two-dwelling unit buildings
shall be exempt from such site plan review and approval.

B.
Each application for subdivision approval, where required,
and each application for site plan approval, where required, shall
be submitted by the applicant to the County Land Use Board for review
and approval, as required by the aforesaid sections, and the Borough
agency shall condition any approval that it grants upon timely receipt
of a favorable report on the application by the County Land Use Board
or approval by the County Land Use Board by its failure to report
thereon within the required time period.
Applications for development shall be filed
with the Clerk of the Borough of Rockaway. The applicant shall file
18 copies of the application for development together with 18 copies
of any plat required by the Land Development Code of the Borough of
Rockaway or by the Municipal Land Use Law of the State of New Jersey.[1] Such application and plat (including but not limited to
sketch plats, concept plans, subdivision plats and site plans) shall
be filed at least 20 days before the date that such application shall
be considered by a Borough agency of the Borough of Rockaway. Any
application for development which is not filed at least 20 days before
the date of a meeting when the application shall be considered will
not be deemed timely filed and may only be considered at the next
regularly scheduled meeting of such Borough agency, provided that
said next regularly scheduled meeting is held more than 20 days after
receipt of said application. No public hearing may be set for an application
for development unless a complete application for development with
the requisite number of plats has been received by the Clerk of the
Borough of Rockaway at least 20 days prior to the date set for said
public hearing. The secretary of the Borough agency shall inform the
applicant of the steps to be taken to initiate applications and of
the regular meeting dates of the Board.

Checklists.
(1)
Consistent with the provisions of N.J.S.A. 40:55D-10.3,
the procedures, regulations and standards on file with the Clerk of
the Borough of Rockaway and incorporated herein by reference are hereby
ordained to be the official process for applications for development
before the Land Use Board of the Borough of Rockaway. All applications
for development shall comply with the requirements as adopted herein.
The checklists of the standards and regulations of this chapter referenced
below are hereby deemed to be the official guides and checklists for
deeming applications for development complete or incomplete as the
case may be.

These checklists shall be used by all applicants when
filing an application for development.
B.
Complete application. Consistent with the provisions
of N.J.S.A. 40:55D-10.3, the administrative officer to whom an application
is submitted shall determine within 45 days whether an application
is complete or incomplete based upon the foregoing checklists.
